Greetings:

In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Hardwick, qualified to vote in town affairs, to meet at the Hardwick Elementary School, 76 Schoolhouse Drive, Gilbertville, Massachusetts on Thursday, April 26th, 2018 at 6:00 P.M., then and there to act on the following articles:
	
Article 1.  .  To see if the Town will vote to raise and appropriate, borrow or transfer from available funds the sum of $1,200,000.00 in addition to the $5,809,000.00 appropriated at the Annual Town Meeting of June 21st, 2014 under Article # 20 for a total of $7,009,000.00 to pay the costs of the Gilbertville Water Pollution Control Facility upgrade project, including but not limited to, the costs of treatment facility improvements, chemical systems upgrades, control building renovation, construction of an operations building, electrical facilities improvements, and payment of all other costs incidental and related thereto, including planning, design and engineering costs; that to meet this appropriation, the Treasurer, with the approval of the Selectmen, is authorized to borrow said amount under and pursuant to Chapter 44, Sections 7(1) and/or 8(20) of the General Laws, or pursuant to any other enabling authority, and to issue bonds or notes of the Town therefor; that the Board of Selectmen are hereby authorized to apply for and accept any grants or loans from the United States Department of Agriculture Rural Development that may be available for the project; and that the amount authorized to be borrowed under this vote shall be reduced by the amount of any grants received for the project, or take any other action relative thereto.

Article 2. .  To see if the Town will vote to raise and appropriate, borrow or transfer from available funds a sum of money to upgrade the Wheelwright Water Pollution Control Facility’s aeration system including but not limited to, the costs of demolition of pumps and miscellaneous process piping, construction of structural concrete pad, purchase and/or installation of fine bubble diffusers, blowers, HACH SC200 universal controllers, HACH LDO DO probes, float mount assembly and payment of all other costs incidental and related thereto, including planning, design and engineering costs; that to meet this appropriation, the Treasurer, with the approval of the Selectmen, is authorized to borrow said amount under and pursuant to Chapter 44, Sections 7(1) and/or 8(20) of the General Laws, or pursuant to any other enabling authority, and to issue bonds or notes of the Town therefor; that the Board of Selectmen are hereby authorized to apply for and accept any grants or loans from the United States Department of Agriculture Rural Development that may be available for the project; and that the amount authorized to be borrowed under this vote shall be reduced by the amount of any grants received for the project, or take any other action relative thereto.

Article 3. To see if the town will vote pursuant to the provisions of MGL., C.44,s.53E ½ as most recently amended by the  Municipal Modernization Act, St.2016, C.218,s.86 “Departmental Revolving Funds” by adding:       
                    
ARTICLE # V - Board of Selectmen
Section 6      DEPARTMENTAL REVOLVING FUND BY-LAW

Section 1.  PURPOSE.
This by-law establishes and authorizes revolving funds for use by town departments, boards, committees, agencies and officers in connection with the operation of programs or activities that generate fees, charges or other receipts to support all or some of the expenses of those programs or activities. These revolving funds are established under and governed by MGL, C.44s.53E1/2.   

Section 2. EXPENDITURE LIMITATIONS.
A department or department manager, board, committee or officer may incur liabilities against and spend monies from a revolving fund established and authorized by this by-law without appropriation subject to the following limitations:
A. Fringe benefits of fulltime employees whose salaries or wages are paid from the fund shall also be paid from the fund. 
B. No liability shall be incurred in excess of the available balance of the fund.
C. The total amount spent during a fiscal year shall not exceed the amount authorized by town meeting on or before July 1 of that fiscal year, or any increased amount of that authorization that is later approved during that fiscal year by the Select Board and Finance Committee.

Section 3. INTEREST. 
Interest earned on monies credited to a revolving fund established by this by-law shall be credited to the General Fund.

Section 4. PROCEDURES AND REPORTS.
Except as provided in MGL, C44,s.53E½ and this by-law, the laws, rules, regulations, policies or procedures that govern the receipt and custody of town monies and the expenditure and payment of town funds shall apply to the use of a revolving fund established and authorized by this by-law. The Town Accountant shall include a statement on the collections credited to each fund, the encumbrances and expenditures charged to the fund and the balance available for the expenditure in the regular report the Town Accountant provides the department, board, committee, agency or officer on appropriations made for its use.

Section. 5 AUTHORIZED REVOLVING FUNDS. The table establishes:
A. Each Revolving Fund authorized for use by a Town department, board, committee agency or officer,
B. The department or agency head, board, committee or officer authorized to spend from each fund,
C. The fees, charges and other monies charged and received by the department, board, committee, agency or officer in connection with the program or activity for which the fund is established that shall be credited to each fund by the Town Accountant,
D. The expenses of the program or activity for which each fund may be used,
E. Any restrictions or conditions on expenditures from each fund;
F. Any reporting or other requirements that apply to each fund, and
G. The fiscal years each fund shall operate under this by-law,
or take any other action relative thereto.

Article 4. To see if the Town will vote to delete the words “to be composed of seven members” as voted at the Annual Town Meeting of May 9, 1989 under Article #32 wherein the Town voted to accept Massachusetts General Law, Chapter 40, Section 8D to establish a Historical Commission and replace it with the words “the commission shall consist of not less than three nor more than seven members” or take any other action relative thereto.
