Appeal No. 12-033: Michael Gettings & Lars Lundgren, 500 Everett St., Westwood, MA 02090, c/o Steven Bohmfalk, , 43 Adams Road, W. Yarmouth, MA 02673, owners of property located at 161 George Ryder Road So., also shown on Assessors’ Book Page 7D as Lot G12. The appellants propose to expand a nonconforming single family dwelling via the addition of an 8 foot by 6 foot foyer on the northerly side, 22.75 feet from the road where a 25 foot setback is required. The lot is nonconforming in that it contains 10,330 sq. ft. where 20,000 sq. ft. is required. The Zoning District is R-20. A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.
Appeal No. 12-034: Richard G. & Sandra E. MacDonald, 9 Hamlins Crossing, Dover, MA 02030, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA 02650, owners of property located at 185 Sears Road, also shown on Assessors’ Book Page 11A1 as Lot 2. The appellants propose to expand a nonconforming single family dwelling via a 33 square foot addition on the southerly side, 45 feet from a Coastal Conservancy District (Top of Bank) where a 50 foot setback is required. Additionally proposed is a relocation of an existing driveway partially within a Coastal Conservancy District (Flood Plain, A7 Zone, el. 9). The lot contains 89,905 sq. ft. total, with 67,811 sq. ft. of buildable upland in an R-40 Zoning District. A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, and Section IV.A.3.c., Overlay Regulations, Conservancy Districts, Special Permit Uses, of the Protective Bylaw.
Appeal No. 12-035: Joseph A. & Ann R. Nellis, 51 Washington Post Drive, Wilton, CT 06897, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA 02650, owners of property located at 21 Watch Hill Way, also shown on Assessors’ Book Page 17C as Lot C2. The appellants propose to expand a nonconforming single family dwelling via the construction of a 7.4 foot by 9 foot addition on the northerly side, and the addition of a partial second floor over an existing garage, expanding an existing bedroom, 16 feet from the westerly lot line where a 25 foot setback is required. The building coverage will increase from an existing 15.7% (1,990 sq. ft.) to 16.2% (2,053 sq. ft.) where a maximum of 15% is allowed. The existing dwelling is nonconforming in that it is located 27.4 feet from Watch Hill Way where a 40 foot setback is required and 17 feet from the westerly lot line where a 25 foot setback is required. The property contains 13,100 sq. ft. total, with 12,664 sq. ft. of buildable upland in an R-40 Zoning District. A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change ,of the Protective Bylaw.
Appeal No. 12-036: Joan Reiguluth Van Nest, P.O. Box 155, No. Chatham, MA 02650, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA 02633, owner of property located at 606 Orleans Road, also shown on Assessors’ Book Page 12J as Lot GD. The appellant proposes to expand a nonconforming single family dwelling/boathouse via the installation of a foundation under the existing structure, converting the first floor boat storage space to living space and expanding the existing second floor over the existing garage, within a Coastal Conservancy District (Flood Plain, el. 11) where a 50 foot setback is required. The existing dwelling is nonconforming in that it is located within a Coastal Conservancy District (Flood Plain, el. 11) where a 50 foot setback is required. The lot is nonconforming in that contains 27,500 sq. ft. where 40,000 sq. ft. is required and 15,525 sq. ft. of buildable upland where 20,000 sq. ft. is required. The Zoning District is R-40. A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.
