The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, May 24, 2012, starting at 4:00 p.m. in the Town Annex Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 12-044:  Dan Brickman, 50 Wee Burn Lane, Darien, CT 06820, c/o Edson Eldredge, 73 Crosswind Farm Road, No. Chatham, MA  02650, owner of property located at 20 David’s Lane, also shown on Assessors’ Book Page 10A as Lot 2.  The appellant has deeded rights to a 10 foot wide easement over property located at 300 Stage Neck Road, owned by Stage Neck Realty Trust, also shown on Assessors’ Book Page 5A as Lot 3, and is requesting the grant of a Special Permit to construct a kayak rack within said easement in a Coastal Conservancy District (Flood Plain & Coastal Bank).  The property contains 5.23 acres in an R-40 Zoning district.  A Special Permit is required under Section IV.A.3.a., Overlay Regulations, Conservancy Districts, Special Permit Uses, of the Protective Bylaw.

Appeal No. 12-045:  100 Marsh View Road Realty Trust, P.O. Box 20, Orleans, MA  02653, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 100 Marsh View Road, also shown on Assessors’ Book Page 8C as Lot S65.  The appellants propose to expand a nonconforming single family dwelling via the demolition of an existing dwelling and construction of a new dwelling, 1 foot from a Coastal Conservancy District (Top of Bank) where a 50 foot setback is required.  The building coverage will increase from an existing 13.8% (1,252 sq. ft.) to 16% (1,450 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located within a Coastal Conservancy District (Coastal Bank) where a 50 foot setback is required.  The lot is nonconforming in that it contains 17,450 sq. ft. where 20,000 sq. ft. is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings & Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-046:  595 Main Street LLC, P.O. Box 25, Chatham, MA  -02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 595 Main Street and 20 & 30 Bearses Byway, also shown on Assessors’ Book Page 14E  as Lots 12-20, 114-23 and 15-23A.  The appellants are requesting a Modification of Special Permit 12-019, granted on March 8, 2012,  to reduce the number of  approved 2-bedroom apartments on the second floor at 595 Main Street from four (4)  to three (3), and relocate the fourth apartment to a newly proposed  second floor over the approved  garage at 20 Bearses Byway.  The connector between the garage and 595 Main Street will be removed so as to render the garage a free-standing building.    Section 14, Powers of Board of Appeals, Authority of Board, of M.G.L., Chapter 40A, The Zoning Act, authorizes the Zoning Board of Appeals to reverse or affirm, in whole or in part, or modify any order or decision.  The property contains 98,059 square feet in a GB-1 Zoning District.

Appeal No. 12-036:  Joan Reiguluth Van Nest, P.O. Box 155, No. Chatham, MA  02650, c/o William F. Riley, Esq., P.O. Box 707, Chatham MA  02633, continued from the April 26, 2012 public hearing for expansion/alterations of a nonconforming single family dwelling at 606 Orleans Road.

Votes
regarding Special Permits, Variances and appeals must be approved by a supermajority as required under said Ch. 40A.
