The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, February 9, 2012, starting at 4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 12-009:  Robert G. Franke, c/o Suzanne F. Horne,  122 Training Field Road, Chatham, MA  02633, owner of property located at 222 Shane Drive, also shown on Assessors’ Book Page 14G as Lot B58.  The appellant proposes to expand a nonconforming single family dwelling via the addition of an 11 foot by 11.5 foot closet on the southeasterly side, 10 feet from the lot line where a 25 foot setback is required.  The building coverage will increase from an existing 16% (1,709 sq. ft.) to 16.9% (1,841 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 35.5 feet from the road where a 40 foot setback is required, and 21 feet from the easterly lot line where a 25 foot setback is required, and covers 16% of the lot where a maximum of 15% is allowed.  The lot is nonconforming in that it contains 10,872 sq. ft. where 40,000 sq. ft. is required. The Zoning District is R-40.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change,  of the Protective Bylaw.

Appeal No. 12-010:  The Chatham Orpheum Theater, Inc., c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, agreed vendees of property located at 637 Main Street, also shown on Assessors’ Book Page 14E as Lot X20.  The appellants propose to convert an existing retail use to a 4,537 Commercial Entertainment Establishment (theater with two screening rooms with 48 and 60 seats, respectively, and a 28-seat cafe).  Additionally proposed is the expansion of a nonconforming structure via the addition of 5 feet  to the existing roof, (changing the pitch of the roof with no increase in building height) 4 feet from the road where a 5 foot setback is required.  The existing  building is nonconforming in that it is located 4 feet from the road where a 5 foot setback is required, and both the the site and building contain various dimensional nonconformities.  The Zoning District is GB-1.  A Special Permit for a Commercial Entertainment Establishment is required under Section III.C.4.c., District Regulations, District Area Regulations, General Business Districts, Uses Requiring a Special Permit, and Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-011:  D. Robert & Anne F. Brebbia, c/o Chris Brebbia, 2095 Main Street, Chatham, MA  02633, owners of property located at 2095 Main Street, also shown on Assessors’ Book Page 6E as Lot S1.  The appellants propose to alter a nonconforming single family dwelling via the enclosure of an existing covered porch, 45 feet from the road where a 50 foot setback is required.  The existing dwelling is nonconforming in that it is located 45 feet from the road where a 50 foot setback is required. The property contains 36,831 square feet in an SB Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-012:  Stanley M. Mann, Trustee, LSM Realty Trust, 286 South Main St., Andover, MA  01810, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650.  The appellant proposes to divide Lots 10, 11 and 12 on Watch Hill Way, (58 Watch Hill Way, also shown on Assessors’ Book Page 17C as Lot C10) eliminating Lot 12 by combining it with Lot 11, and  create a new boundary lot line between Lot 11 and Lot 10 which will add more total lot area and Buildable Upland area to Lot A, but will result and less total lot area and Buildable Upland and an increase in frontage in a newly created “Lot B”, which contains a single family dwelling, as shown on a plan prepared by Coastal Engineering Co., Inc., dated December 11, 2011 and labeled Project No. 17432-01.  The reduction in total lot area in “Lot B” from that previously contained in the existing Lot 10 will required the grant of a dimensional Special Permit under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.
