The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, February 23, 2012, starting at 4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 12-013:  J. Clarke Gray & Barbara Stumm-Gray, 805 Ramapo Way, Westfield, NJ  07090, c/o Peter S. Farber, Esq., P.O. Box 768, No. Chatham, MA  02650, owners of property located at 30 Bridge Street, also shown on Assessors’ Book Page 14A as Lot 5.  The appellants propose to expand a nonconforming single family dwelling via the partial demolition of an existing dwelling and construction of additions and swimming pool, with the location of the dwelling 3.4 feet from a Coastal Conservancy District (Top of Bank) and 38.89 feet from another Coastal Conservancy District (Flood Plain, el. 10) where a 50 foot setback is required.  The proposed swimming pool is located with the required 50 foot setback to the Flood Plain.  The building coverage will increase from an existing 10.3% (3,309 sq. ft.) to 12.8% (4,136 sq. ft.) where a maximum of 10% is allowed.  The existing dwellings are nonconforming in that the main dwelling is located 3.4 feet from a Coastal Conservancy District (Top of Bank) where a 50 foot setback is required and the guest dwelling is located 19.5 feet from the road where a 40 foot setback is required and 24.6 feet from the westerly lot line where a 25 foot setback is required. The building coverage, at 10.3%, exceeds the maximum allowable coverage of 10%.  The property is nonconforming in that it contains two dwelling units where there is sufficient buildable upland for only one dwelling, and a circle with diameter of 100 ft. cannot be placed within the buildable upland portion of the lot. The property contains 223,000 sq. ft. total, with 32,314 sq. ft. of buildable upland in an R-40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-014:  Joseph L. & Gretchen W. Meeks, 136 Dakin Road, Sudbury, MA  01776, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 229 Pleasant Street, also shown on Assessors’ Book Page 2B as Lot 30.  The appellants propose to expand a nonconforming single family dwelling via the addition of a 22 foot by 26 foot garage on the westerly side, 10.2 feet from the southerly lot line where a 15 foot setback is required.  The lot is nonconforming in that it contains 80.7 linear feet of frontage where 100 ft. is required.  The property contains 23,125 sq. ft. in an R-20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 12-015:  56 Jericho LLC, 555 Sparrowbush Road, Wyckoff, NJ   07481, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 56 Jericho Lane, also shown on Assessors’ Book Page 10C as Lot B5.  The appellants propose to install timber steps with rope railing, posts and low voltage lighting and a 3 foot wide footpath along an existing bulkhead in a Coastal Conservancy District (Coastal Bank).  The property contains 18,109 sq. ft. in an R-20 Zoning District.  A Special Permit is required under Section  IV.A.3.a., Overlay Regulations, Conservancy Districts, Special Permit Uses,  of the Protective Bylaw.

Appeal No. 12-016:  Mary J. Feightner, 36 Somerset Drive, Chatham, MA  02633, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owner of property located at 36 Somerset Drive, also shown on Assessors’ Book Page 11G as Lot H6.  The appellant proposes to expand a nonconforming single family dwelling via the addition of a 24 foot by 24 foot master bedroom, bath and storage on the easterly side, 34.4 feet from the road where a 40 foot setback is required and 21 feet from the southeasterly lot line where a 25 foot setback is required, an approximately 10 foot by 24 foot deck on the easterly side, 22.4 feet from the lot line where a 25 foot setback is required, and an 8 foot by 24 foot expansion of an existing dining room and new laundry room on the westerly side.  The building coverage will increase from an existing 10.8% (1,228 sq. ft.) to 15.2% (1,720 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 30.1 feet from the road where a 40 foot setback is required, and 22.2 feet from the southerly lot line where a 25 foot setback is required.  The lot is nonconforming in that it contains 11,346 sq. ft. where 60,000 sq. ft. is required, and 140.27 linear ft. of frontage where 150 ft. is required.   The Zoning District is R-60.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change,   of the Protective Bylaw
