Agenda: | TOWN OF CHATHAM ZONING BOARD OF APPEALS LEGAL NOTICE The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, May 23, 2013, starting at 3:00 p.m. in the Town Annex Meeting Room, 261 George Ryder Road, on the following appeals: Appeal No. 13-028: Ulad Investment, LLC, 6 Nokomis Way, Natick, MA 01760, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA 02650, owners of property located at 94 Uncle Alberts Drive, also shown on Assessors’ Book Page 12E as Lot 1. The appellants propose to create a 4-foot wide Unpaved Trail and install a 60 foot by 3 foot seasonal catwalk in a Coastal Conservancy District (Flood Plain, el. 7 and Salt Marsh). The property contains 43,900 sq. ft. in an R-40 Zoning District. A Special Permit is required under Section IV.A.3.a., Overlay Regulations, Conservancy Districts, Special Permit Uses, of the Protective Bylaw. Appeal No. 13-029: Frost Fish Creek Tennis Association, Inc., c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA 02650, agreed vendees of property owned by My Girls Marine LLC and located at 615 Orleans Road, also shown on Assessors’ Book Page 12I as Lot 7. The appellants are requesting the grant of a Special Permit for the construction and operation of a private, not for profit club. An existing structure will be demolished and a new structure and tennis courts will be constructed in compliance with the dimensional requirements of the bylaw. The property contains 56,319 sq. ft. in an R-40 Zoning District. A Special Permit is required under Section III.C.1.c., District Regulations, District Area Regulations, Residential Districts, Uses Requiring a Special Permit of the Protective Bylaw. Appeal No. 13-030: Norah Geraghty, 35 Partridge Road, Etna, NH 03750, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA 02633, owner of property located at 53 Grist Mill Lane, also shown on Assessors’ Book Page 15C as Lot 3C. The appellant proposes to install a 36 foot by 3 foot catwalk in a Coastal Conservancy District (between the high water mark and the seaward edge of a Salt Marsh). The property contains 41,785 sq. ft. in an R-40 Zoning District. A Special Permit is required under Section IV.A.3.a., Overlay Regulations, Conservancy Districts, Special Permit Uses, of the Protective Bylaw. Appeal No. 13-016: Capri Lane Association LLC, 86 Capri Lane, Chatham, MA 02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA 02633, owners of property located at Lot C13 Capri Lane, also shown on Assessors’ Book Page 13C as Lot C13. Continued from the March 28, 2013 public hearing for the construction of a association pier in a Coastal Conservancy District. A request has been filed to continue this hearing to June 13, 2013. Other Business: A discussion will be conducted regarding how the Zoning Board of Appeals will proceed in light of the results of the Hallock v Chandler case.
