	LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, July 11, 2013  starting at  4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 13-040:  Richard Kahn, 372 Fox Hill Road, Chatham, MA  02633, owner of property located at 372 Fox Hill Road, also shown on Assessors’ Book Page 11M as Lot 4.  The appellant proposes to install an elevated stairway and platform to replace at grade steps lost to erosion in a Coastal Conservancy District (Flood Plain, el. 11).  The property contains 61,389 sq. ft. in an R-40 Zoning District.  A Special Permit is required under Section IV.A.3.a., Overlay Regulations, Conservancy Districts, Special Permit Uses, of the Protective Bylaw.

Appeal No. 13-041:  Eric J. & Sarah G. Wilsterman, 110 School St., Chatham, MA  02633, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 110 School Street, also shown on Assessors’ Book Page 16C as Lot 7B.  The appellants propose to expand a nonconforming single family dwelling via the addition of a dining room and screened porch on the westerly side, 13.2 feet from the northerly lot line where a 15 foot setback is required, and the addition of a 6 sq. ft. roof over an existing entry on the easterly side, 24 feet from the road where a 25 foot setback is required.  The building coverage will increase from an existing 12.4% to 15.3% where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 12.3 feet from the northerly lot line where a 15 foot setback is required.  The lot is nonconforming in that it contains 11,580 sq. ft. where 20,000 sq. ft. is required.   The Zoning District is R-20.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-042:  John L. O’Brien, 70 Apple Blossom Lane, Lynn, MA  01904, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owner of property located at 393 Main St., also shown on Assessors’ Book Page 16D as Lot 3.  The appellant is requesting the grant of a Special Permit to convert an existing structure used commercially to a single family dwelling.  The appellant also proposes to construct an addition containing a kitchen and sunroom on the southerly side, 5 feet from the lot line where a 15 foot setback is required for a single family dwelling in a GB-1 Zoning District.  The property is nonconforming in that it contains a structure on the easterly side 0.2 feet from the lot line where a 5 foot setback is required.  The property contains 9,311 sq. ft. in a GB-1 Zoning District.  A Special Permit is required under Section III.C.4.c., District Regulations, District Area Regulations, General Business Districts, Uses Requiring a Special Permit and Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.
