Agenda: | TOWN OF BARRE ANNUAL TOWN MEETING JUNE 18, 2013 WORCESTER, ss: To one of the Constables in the Town of Barre, in the County of Worcester, GREETINGS: In the name of the Commonwealth of Massachusetts, you are hereby directed to notify and warn the inhabitants of the Town of Barre, qualified to vote in town elections and town affairs to meet at the Ruggles Lane School Auditorium on TUESDAY, THE EIGHTEENTH OF JUNE 2013 AT 6:30 P.M. then and there to act on the following articles: ARTICLE 1 CHOOSE TOWN OFFICERS To see if the Town will vote to choose all other town officers, agents and committees not elected by ballot or appointed, or take any other action relative thereto. ARTICLE 2 REPORTS FROM COMMITTEES To see if the Town will vote to hear the reports of the Selectmen, Finance Committee, School Committee and any other department or committee and act thereon, or take any other action relative thereto. ARTICLE 3 CHAPTER 90 GRANT To see if the Town will vote to accept any and all state highway assistance funds authorized by the state legislature and approved by the Massachusetts Department of Transportation- Highway Division under the so-called Chapter 90 Highway Assistance Program to be expended for the maintenance, repair and construction of Town roads in anticipation of reimbursement under the direction of the Board of Selectmen for work on roads located on the State Aid Primary System as approved by the Massachusetts Department of Transportation-Highway Division, and further to authorize the Treasurer/Collector, with the approval of the Board of Selectmen, to borrow money from time to time during Fiscal Year 2014 up to the reimbursable amount, for the period from July 1, 2013 through June 30, 2014, in anticipation of reimbursement of said highway assistance in conformity with the provisions of Massachusetts General Laws, Chapter 44, Section 6A, or take any other action relative thereto. ARTICLE 4 TREASURER/COLLECTOR BORROWING To see if the Town will vote to authorize the Treasurer/Collector, with the approval of the Board of Selectmen, to borrow money from time to time in anticipation of revenue for the twelve month period beginning July 1, 2013, in accordance with the provisions of Massachusetts General Laws, Chapter 44, Section 4, and to renew any note or notes as may be given for a period of less than one year, or take any other action relative thereto. ARTICLE 5 REVOLVING FUNDS To see if the Town will vote to authorize revolving funds for certain town departments pursuant to Massachusetts General Law Chapter 44, Section 53E ½ for the fiscal year beginning July 1, 2013, or take any other action relative thereto. ARTICLE 6 FY 2014 OMNIBUS BUDGET To see if the Town will vote to raise such sums as may be deemed necessary to pay town charges and expenses for the fiscal year beginning July 1, 2013 and vote to fix salary and compensation of all elected officials of the Town in accordance with the provisions of Massachusetts General Laws, Chapter 41, Section 108, effective July 1, 2013 and make all appropriations for the same, or take any other action relative thereto. ARTICLE 7 FY 2014 SEWER ENTERPRISE BUDGET To see if the Town will vote to raise and appropriate, borrow or transfer from Sewer Receipts a Sum of Money for the operations and maintenance of the municipal sewer system for the fiscal year beginning July 1, 2013, or take any action relative thereto. ARTICLE 8 FUNDING OF WATER ENTERPRISE FUND To see if the Town will vote to transfer from available funds a Sum of Money to establish the Water Department as an Enterprise Fund effective July 1, 2013, or take any action relative thereto. ARTICLE 9 FY 2014 WATER ENTERPRISE BUDGET To see if the Town will vote to raise and appropriate, borrow or transfer from Water Receipts for the operations and maintenance of the municipal water system for the fiscal year beginning July 1, 2013, or take any action relative thereto. ARTICLE 10 FY 2013 SNOW REMOVAL OT/PT ACCOUNT To see if the Town will vote to raise and appropriate, borrow or transfer from available funds a sum of money to the FY 2013 Snow Removal Overtime/Part-time Account; or take any other action relative thereto. ARTICLE 11 FY 2013 SNOW REMOVAL EXPENSE ACCOUNT To see if the Town will vote to raise and appropriate, borrow or transfer from available funds a sum of money to the FY 2013 Snow Removal Expense Account; or take any other action relative thereto. ARTICLE 12 MONTACHUSETT REGIONAL VOCATIONAL STABILIZATION FUND To see if the Town will vote to approve the establishment of a Stabilization Fund according to M.G.L. Chapter 71, Section 16 G ½ for the Montachusett Regional Vocational Technical School District, or take any action relative thereto. ARTICLE 13 GASB 45 ACTUARIAL VALUATION To see if the Town will vote to raise and appropriate, borrow or transfer from available funds a sum of money for the Town’s tri-annual GASB 45 Actuarial Valuation, or take any action relative thereto. ARTICLE 14 HENRY WOODS BUILDING REPAIRS To see if the Town will vote to raise and appropriate, borrow, or transfer from available funds, a Sum of Money for the purpose of paying for interior repairs to the Henry Woods Building including flooring, sheetrock, and painting; or take any action relative thereto. ARTICLE 15 HENRY WOODS BUILDING ROOF REPLACEMENT To see if the Town will vote to raise and appropriate, borrow, or transfer from available funds, a Sum of Money for the purpose of paying for construction services for the repair of the Henry Woods Building roof, or take any action relative thereto. ARTICLE 16 WOODS MEMORIAL LIBRARY AIR SEAL AND INSULATION To see if the Town will vote to raise and appropriate, borrow, or transfer from available funds, a Sum of Money for the purpose of paying costs to air seal, insulate and replace wiring in the attic of the Woods Memorial Library in excess of the amount the Town is eligible to receive from the Green Communities Grant Program for said project; or take any other action relative thereto. ARTICLE 17 BULLET PROOF VESTS To see if the Town of Barre will vote to raise and appropriate, borrow, or transfer from available funds, a Sum of Money for the purpose of purchasing new bullet proof vests; or take any action relative thereto. ARTICLE 18 NETWORK AND SECURITY MAINTENANCE FOR TOWN DEPARTMENTS To see if the Town will vote to raise and appropriate, borrow, or transfer from available funds, a Sum of Money for the purpose of paying the costs associated to network all town departments, off-site backup, and security maintenance for all town departments; or take any action relative thereto. ARTICLE 19 AMEND PURPOSE OF STM 11/26/12 ARTICLE 13 To see if the Town will vote to amend the purpose of Article 13 of the November 26, 2012 Special Town Meeting vote from using $7,000 in Free Cash to purchase permitting software to be used by town departments to purchase software to be used by town departments; or take any other action relative thereto. ARTICLE 20 ADOPTION OF MGL CHAPTER 39, SECTION 23D: THE MULLIN RULE To see if the Town will vote to adopt Chapter 39 Section 23D to allow a member of any municipal board, committee or commission when holding an adjudicatory hearing to be able to vote on a matter if they have missed a single session of the hearing at which testimony or other evidence has been received. Before such member votes, the member shall certify in writing that he has examined all evidence receivfed at the missed session or a transcript thereof and the written certification shall be part of the record of the hearing. Acceptance of this section shall not change, replace, negate or otherwise supercede applicable quorum requirements. ARTICLE 21 ACCEPTANCE OF BARRE HS SCHOLARSHIP TRUST FUNDS To see if the Town will vote to authorize the Selectmen to accept funds from the Barre High School Alumni Committee and to create a Barre HS Trust Fund Commission to administer said funds and future donations to the Trust Fund; or take any action relative thereto. ARTICLE 22 ACCEPTANCE OF NELSON WAY-CITIZEN’S PETITION To see if the Town of Barre will accept Nelson Way as shown on a plan of land entitled “Definitive Subdivision Nelson Way, Barre, Massachusetts” by Graz Engineering LLC, dated June 15, 2004 and revised on July 28, 2004 and August 3, 2004 and recorded in Plan Book 816, Plan 78, and further described on Exhibit A attached hereto; or take any action relative thereto. ARTICLE 23 WINTER PARKING BAN BYLAW To see if the Town will vote amend the Town of Barre General Bylaws, Chapter 128; or take any other action relative thereto. ARTICLE 24 AMENDMENT TO ELECTION AND APPROPRIATIONS MEETING BYLAW To see if the Town will vote to amend the Town of Barre General Bylaws, Chapter 119 Section 3 by adding a second paragraph as follows: “All Town Officers whose positions are elected by ballot, must qualify by taking an oath before the Town Clerk and completing any necessary paperwork relating to the state conflict of interest and open meeting laws, within 30 days of the date of the election. Failure to do so will be considered a failure to elect and the Board of Selectmen will proceed in accordance with M.G.L.; or taken any other action relative thereto. ARTICLE 25 AMENDMENT TO ANIMALS BYLAW To see if the Town will vote to amend the Town of Barre General Bylaws, Chapter 11 on Animals; or take any other action relative thereto. ARTICLE 26 DELETION OF PERSONNEL BYLAW To see if the Town will vote to delete the Town of Barre General Bylaws, Chapter 84 on Personnel and authorize the Board of Selectmen to replace the bylaw with a Town Personnel Policy Manual; or take any other action relative thereto. You are directed to serve this Warrant by posting an attested copy thereof in the bulletin boxes at Ruggles Lane School, at the Town Hall and 50 Main Street, South Barre and on the bulletin boards of the Town Clerk, Henry Woods Building, and the Barre Senior Center. Hereof, fail not, and make due return of this warrant with your doings thereon, to the Town Clerk at the time and place of said meeting as aforesaid.
