ZONING BOARD OF APPEALS
LEGAL NOTICE
The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, April 25, 2013, starting at 4:00 p.m. in the Town Annex Meeting Room, 261 George Ryder Road, on the following appeal:
Appeal No. 13-026: David Oppenheim, c/o Michael D. Ford, Esq., P.O. Box 485, W. Harwich, MA 02671, owner of property located at Lot 1 Isaac Hardy Lane, also shown on Assessors’ Book Page 16D as Lot 1. The appellant is requesting a Modification of Special Permit 06-008, issued on January 17, 2006, to change the maximum building coverage on Lot 1, listed in a table in Condition No. 22, from 2,800 square feet to 2,900 square feet, resulting in a proposed building coverage of 12.4%, and to correct the lot area of the subject parcel in the table from 28,375 sq. ft. to 23,375 sq. ft. The property contains 23,375 sq. ft. in GB-2 and R-20 Zoning Districts. Section 14, M.G.L. Ch. 40A, The Zoning Act, authorizes the Zoning Board of Appeals to make orders or decisions, reverse or affirm in whole or in part, or modify any order or decision.
Appeal No. 13-027: Kenneth F. & Elizabeth Sommer, 10 Cove Hill Road, No. Chatham, MA 02650, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA 02650, owners of property located at 416 Main Street, also shown on Assessors’ Book Page 16D as Lot 8. The appellants are requesting a Modification of Special Permit 12-004, issued on January 20, 2012, which allowed for expansion of a storage shed into the R-20 portion of the lot under Section III.D.3.i., District Regulations, District Area Regulations, Lot in More Than One District of the Protective Bylaw. The request sought for Modification of Special Permit 12-004 is to allow the moving of a structure now located at 471 Main Street on to the lot instead of the demolition and construction of the expanded storage shed. The proposed relocated building will comply with the dimensional requirements of the Bylaw, but is a different shape and size than the previously permitted structure. The property contains 18,627 sq. ft. in GB-2 and R-20 Zoning Districts. Section 14, M.G.L. Ch. 40A, The Zoning Act, authorizes the Zoning Board of Appeals to make orders or decisions, reverse or affirm in whole or in part, or modify any order or decision.
