	LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, July 25, 2013  starting at  4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 13-043:  Brian E. & Linda M. Miner, P.O. Box 575, Marlboro, MA  01752, c/o James M. Norcross, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 671 Orleans Road, also shown on Assessors’ Book Page 12I as Lot 4.  The appellants propose to expand a nonconforming single family dwelling via the removal of an existing 80 square foot garden shed and the addition of a 240 square foot shed, 5 feet from the easterly lot line where a 25 foot setback is required.  The existing dwelling is nonconforming in that it is located 11 feet from the easterly lot line and 22 feet from the westerly lot line where a 25 foot setback is required and a guest cottage is located 20 feet from the westerly lot line where a 25 foot setback is required.   The property is nonconforming in that it contains 88 linear feet of frontage where 150 feet is required, and contains a main dwelling and a guest cottage where there is sufficient land for only one dwelling.  The property contains 40,108 sq. ft. in an R-40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-044:  Valerie S. Santullo, 39 Kendrick Harvest Way, Chatham, MA  02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owner of property located at 39 Kendrick Harvest Way, also shown on Assessors’ Book Page 13F as Lot 7.  The appellant is requesting the grant of a Dimensional Variance to construct a 32.33 foot by 6 foot covered front porch on the northeasterly side, 20.5 feet from the road where a 25 foot setback is required.  The lot and the existing dwelling are dimensionally conforming to the requirements of the Protective Bylaw for an R-20 Zoning District, therefore, because a nonconformity would be created by the addition of a porch within the required setback to a road, a Dimensional Variance is required under Section VIII.D.2.c., Zoning Board of Appeals, Powers, Variances, of the Protective Bylaw.  The property contains 20,649 sq. ft. in an R-20 Zoning District.

Appeal No. 13-045:  Elizabeth Konvalinka, 35 Eldon Road, London W85TP, England, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owner of property located at 58 Old Salt Works Road, also shown on Assessors’ Book Page 13M as Lot C29.  The appellant proposes to expand a nonconforming single family dwelling via the removal of an existing garage on the easterly side and the construction of a swimming pool, deck and new garage, partially within a Coastal Conservancy District (Flood Plain, el. 11) where a 50 foot setback is required, and within the required 50 foot setback to another Coastal Conservancy District (Top of Bank).  The proposed deck is located 20 feet from the easterly lot line where a 25 foot setback is required.   The building coverage will increase from an existing 18% (2,217 sq. ft.) to 20% (2,479 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 22 feet from the easterly lot line where a 25 foot setback is required, within the required 50 foot setback to a Coastal Conservancy District (Flood Plain, el. 11 and Top of Coastal Bank), and covers 18% of the buildable upland where a maximum of 15% is  allowed.  The lot is nonconforming in that it contains 22,180 sq. ft. where 40,000 sq. ft. is required, 12,366 sq. ft. of buildable upland where 20,000 sq. ft. is required, and 122.5 linear feet of frontage where 150 feet is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.




Appeal No. 13-046:  Barbara Wissner, 7 Stoneymeade Way, Acton, MA  01720, c/o Ryan Protz, 5 Susan Ave., Plymouth, MA   02360, owner of property located at 50 Winterset Drive, also shown on Assessors’ Book Page 11G as Lot H111.  The appellant proposes to expand a nonconforming single family dwelling via the addition of a deck on the southerly side, 17 feet from the lot line where a 25 foot setback is required.  The existing dwelling is nonconforming in that it is located 35 feet from the road where a 40 foot setback is required and 21 feet from the easterly lot line where a 25 foot setback is required.  The lot is nonconforming in that it contains 14,441 square feet where 60,000 sq. ft. is required.     The Zoning District is R-60.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.
