Agenda: | TOWN OF CHATHAM ZONING BOARD OF APPEALS LEGAL NOTICE The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, December 5, 2013, starting at 3:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals: Appeal No. 13-078: Douglas and Kim Burcin, 359 West Park Road, Killington, VT, 05751, c/o William Saltonstall, AIA, LEED A.P., Saltonstall Architects, 380 Wareham St, Marion, MA 02738 owners of property located at 231 Eastward Road, also shown on the Town of Chatham’s Assessors’ Map 13M, Block 27, Lot C43. The appellant proposes to expand a nonconforming structure via construction of two second floor dormers on the west side of the dwelling and addition of a second floor balcony on the north side. The existing dwelling is nonconforming in that it is located 28 feet from Eastward Road where 40 feet is required and 28 feet from a Coastal Conservancy District where 50 feet is required. The existing parcel is nonconforming in that it contains 23,106 square feet where 40,000 square feet is required. The Zoning District is R-40. A Special Permit is required under Section V.B. The appellant proposes to expand a nonconforming structure and property via the construction of exterior mechanical system appliances (air conditioning compressors) 5.3 feet from the lot line where 25 feet is required. The existing structure is nonconforming in that it is located 2.4 feet from the lot line where 25 feet is required, 0 feet from a Coastal Conservancy District where 50 feet is required, and covers 34.6% of buildable upland where the allowed total is 15%. The lot is nonconforming in that it contains 6,834 square feet of buildable upland where 20,000 square feet is required. The total lot area is 40,438 square feet in a R-40 Zoning District. The appellant proposes to expand a nonconforming structure and property via the construction of exterior mechanical system appliances (air conditioning compressors) 14 feet from the lot line where 25 feet is required. The existing structure is nonconforming in that it is located 20 feet from the lot line where 25 feet is required and 37.8 feet from the top of a coastal bank where 50 feet is required. The lot is nonconforming in that it contains 26,620 square feet of buildable upland where 40,000 square feet is required. The property is located in a R-40 Zoning District. A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw. Appeal No. 13-079: 26 Cross Street LLC, c/o Michael D. Ford, Esq. 78 Main Street, PO Box 485, W. Harwich, MA 02671, owner of property located at 26 Cross Street, also shown on the Town of Chatham’s Assessors’ Map 15D, Block 4, Lot 19. The appellant proposes to convert a multi-building hotel to 8 single family dwellings where single family dwellings are permitted via the issuance of a Special Permit and to change, alter or expand pre-existing nonconforming structures. The restaurant use will be abandoned and the swimming pool removed. One of the existing 9 buildings will be razed. No new structures will be constructed except for the addition of garages to be used in conjunction with the 8 single family dwellings. The conversion of use to single family dwellings triggers an increase in setback requirements of 25 feet from the road where 5 feet exists and 15 feet from an abutter where 5 feet exists requiring a Special Permit. The property consists of a total area of 93,055 square feet where a minimum of 5,000 square feet is required and 68,924 square feet of buildable upland where a minimum of 20,000 square feet is required. The proposed lot coverage is 30,230 square feet with the existing lot coverage being 40,580 square feet. The property is located in a GB-1 Zoning District. Special Permits are required under Section III, C, 4, c, 26 District Regulations, District Use Regulations, GB-1 and Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw. Appeal No. 13-067: George Herzlinger, 560 Concord Avenue, Belmont, MA 02478, c/o Minglewood Homes, Inc., 1281 Main Street, Chatham, MA 02633, owners of property located at 108 Shore Road, also shown on the Town of Chatham Assessors’ Map 16D, Block 19, Lot 26. The appellants propose to expand a nonconforming single family dwelling via the addition of a generator 5 feet from the easterly lot line where a 25 foot setback is required. The property is nonconforming in that it contains a main dwelling and a guest house on 59,429 square feet where 60,000 square feet is required. A Special Permit is required under Section V.B., Nonconforming Lots, Buildings, and Uses, Enlargement, Extension or Change, of the Protective Bylaw. Appeal No. 13-071: Mooncusser Lane LLC, 101 Depot Road, Chatham, MA 02633, owners of property located at Lot 2 Mooncussers Lane also shown on the Town of Chatham Assessor’s Map 10A, Block 4, Lot H2. The Appellants propose to construct 267 square feet of a driveway in a Conservancy District. The lot is 53,541 square feet and is located in an R-40 Zoning District. A Special Permit is required under Section IV.A.3.c, Conservancy Districts, of the Protective Bylaw. Continued from November 21, 2013.
