	  LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, June 13, 2013  starting at  4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 13-031:  Michael & Martha A. Farmer, 84 Joshua Drive, Richboro, PA  18954, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA 02650, owners of property located at 32 Nantucket Drive, also shown on Assessors’ Book Page 6B as Lot 88.  The appellants propose to expand a nonconforming single family dwelling via the addition of a bay window on the westerly side, 12.5 feet from the lot line where a 15 foot setback is required, dormers on the westerly side within the required 50 foot setback to a Coastal Conservancy District (Flood Plain, el. 10 and Coastal Bank).  The building coverage will increase from an existing 21.1% (2,118 sq. ft.) to 21.2% (2,134 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 9.5 feet from the westerly lot line, 10.5 feet from the northerly lot line where a 15 foot setback is required from each lot line, is partially located within the required 50 foot setback to a Coastal Conservancy District, and covers 21.1% of the lot where a maximum of 15% is allowed.    The property contains 10,800 sq. ft. in an R-20 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 13-032:  John & Kathryn Delea, 9 Grey Fox Lane, Westford, MA  01886, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 43 Cross St., also shown on Assessors’ Book Page 15D as Lot 63A.  The appellants are requesting Modifications to Special Permits 08-014 and 11-016, issued on February 19, 2008 and April 25, 2011, respectively,  to remove a condition which prohibits the installation of plumbing on the second floor of an existing garage;  the appellants wish to install a half bath on the second floor of the garage.   The property contains 13,910 sq. ft. in a GB-1 Zoning District.  Section 14, Powers of Board of Appeals of M.G.L. Chapter 40A, The Zoning Act, authorizes the Zoning Board of Appeals to reverse, affirm in whole or in part, or modify any order or decision.   

Appeal No. 13-033:  Frank Steindler, 100 Riverside Drive, Apt. 7C, New York, NY  10024, c/o Matthew Creighton, BSC Group, Inc., 349 Route 28, Unit D, W. Yarmouth, MA  02673, owner of property located at 592 Old Harbor Road, also shown on Assessors’ Book 16H, Lot 7.  The appellant proposes to install an elevated stairway in a Coastal Conservancy District (Coastal Beach) to replace at-grade steps which were destroyed in a storm.   The property contains 137,900 sq. ft. in an R-40 Zoning District.   A Special Permit is required under Section IV.A.3.a., Overlay Regulations, Conservancy Districts,  Special Permit Uses, of the Protective Bylaw. 

Appeal No. 13-034:  Chatham Orpheum Theater, 637 Main St., Chatham, MA  02633, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 637 Main Street, also shown on Assessors’ Book Page 14E as Lot X20.  The appellants are requesting the grant of a Permit granted by the Sign Code Appeals Committee under Section 225-19, Appeal Permits,  of the Chatham Sign Code under Section 225-4, Regulations for General, Business, and Industrial Zones, of the Chatham Sign Code to replace an approximately 29 square foot overhanging, projecting marquis sign with a sign of the same size where a maximum of 6 square feet is allowed.  Additionally proposed is a sign on the front façade with continuous LED strip lighting below where internal lighting is not allowed under Section 225-7, Prohibited Signs of the Sign Code, and two 11 square foot window signs on the left façade, covering 100% of the windows where a maximum of 25% coverage is allowed, and a 12 square foot sign on the westerly façade;  the maximum number of signs allowed per business (1 ground, 1 wall and window signs)  in a GB-1 Zoning District will be exceeded.    The property is a condominium unit located in a GB-1 Zoning District.   A Permit is required under Section 225-19, Appeals Permits of Section 225, the Chatham Sign Code.
