The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, February 14, 2013,  starting at  4:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 13-003:  Albert & Suellen Kutenplon, 43 Garvey Road, Framingham, MA  01710, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 222 Barcliff Avenue, also shown on Assessors’ Book Page 14G as Lot 11.  The appellants propose to expand a nonconforming single family dwelling via a 9 foot by 20 foot addition on the southeasterly side, 23.7 feet from the easterly lot line where a 25 foot setback is required, and 33.6 feet from the road where a 40 foot setback is required.  The existing dwelling is nonconforming in that it is located 33.1 feet from the road where a 40 foot setback is required and 21.4 feet from the westerly lot line where a 25 foot setback is required.  The lot is nonconforming in that it contains 20,500 sq. ft. where 40,000 sq. ft. is required, and 91.5 linear ft. of frontage where 150 ft. is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-005:  Joseph & Mary Ellen Fitzpatrick, 50 Old Salt Works Road, Chatham, MA  02633, owners of property located at 50 Old Salt Works Road, also shown on Assessors’ Book Page 13M as Lot C30.  The appellants propose to expand a nonconforming single family dwelling via the 13 foot by 12 foot sunroom on the southeasterly side, 20.5 feet from a Coastal Conservancy District (Flood Plain, A9 Zone, el. 11) where a 50 foot setback is required.  The building coverage will increase from an existing 14.3% (2,480 sq. ft.) to 15.3% (2,649 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it is located 19.9 feet from a Coastal Conservancy District (Flood Plain, el. 11) where a 50 foot setback is required.  The lot is nonconforming in that it contains 23,522 sq. ft. where 40,000 sq. ft. is required,  17,293 sq. ft. of buildable upland where 20,000 sq. ft. is required, and 122.5 linear ft. of frontage where 150 ft. is required.  The Zoning District is R-40.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-006:  William F. & Donna C. Cupelo, 4 Newell Drive, Franklin, MA  02038, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 25 Ryder Pond East Road, also shown on Assessors’ Book Page 17G as Lot M7. The appellants propose to expand a nonconforming single family dwelling via the addition of a garage, mudroom and screened porch on the westerly side.  The proposed additions will comply with  setback and height requirements, however, the building coverage will increase from an existing 2,474 sq. ft. to 3,499 sq. ft. where a maximum of 2,900 sq. ft. is allowed.  The existing dwelling is nonconforming in that it is located 20.2 ft. from the northerly lot line where a 25 ft. setback is required, and the lot is nonconforming in that it contains 29,570 sq. ft. where 60,000 sq. ft. is required.  The Zoning District is R-60.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-007:  Timothy and Mary Christine Sheehan, 34 Main St., Wenham, MA  01984, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 314 Morris 

Island Road, also shown on Assessors’ Book Page 15A ass Lot H87.  The appellants are requesting a Modification of Special Permit 12-047 (issued on August 2, 2012)  to allow an increase in height of the proposed FEMA-compliant foundation of 1.5 feet, increasing the ridge height of the proposed dwelling to 32.5 feet above average grade where a maximum of 30 feet is allowed.  Section 14 of M.G.L. Ch. 40A, The Zoning Act, authorizes the Zoning Board of Appeals to make orders or decisions, reverse or affirm in whole or in part, or modify any order or decision.  The property contains 40,921 sq. ft. total, with 22,300 sq. ft. of buildable upland, in an R-40 Zoning District.

Appeal No. 13-010:  Chatham Orpheum Theater, Inc.,  637 Main St., Chatham, MA  02633, c/o William G. Litchfield, Esq., 330 Orleans Road, No. Chatham, MA  02650, owners of property located at 637 Main Street, also shown on Assessors’ Book Page 14E as Lot X20.  The applicants are requesting the grant a of a Permit granted by the Sign Code Appeals Committee under Section 225-19, Appeal Permits,  of the Chatham Sign Code to create a pattern in the applied shingles on the southerly side which functions as a sign.  The proposed sign will be 4.5 feet high where a maximum of 3 feet is allowed, and 136 square feet in size where  a maximum of 119 square feet is allowed (10% of the building face) under Section 225-4, Regulations for General, Business, and Industrial Zones, of the Chatham Sign Code.    The property is located in a GB-1 Zoning District.
