	LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, June 27, 2013  starting at  3:00 p.m. in the Town Annex Meeting Room,  261 George Ryder Road, on the following appeals:

Appeal No. 13-035:  24 Nameless Lane Nominee Trust, 101 Depot Road, Chatham, MA  02633, c/o Polhemus Savery DaSilva, 101 Depot Road, Chatham, MA  02633, owners of property located at 24 Nameless Lane, Chatham, MA  02633, also shown on Assessors’ Book Page 15D as Lot V19.  The appellants propose to expand a nonconforming single family dwelling via the demolition of an existing dwelling and construction of a new dwelling.  The proposed new dwelling will comply with the dimensional requirements of the Protective Bylaw,  however, the demolition of a nonconforming dwelling and construction of a new dwelling in a different location requires the grant of a Special Permit.     The lot is nonconforming in that it contains 10,130 sq. ft. where 20,000 sq. ft. is required. The Zoning District is R-20.   A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw. 

Appeal No. 13-036:  Ethan & Helen Arnold, 20 Bows St., Cohasset, MA  02025, c/o Michael D. Ford, Esq., P.O. Box 485, W. Harwich, MA  02671, owners of property located at 48 Howes Lane, Chatham, MA  02633, also shown on Assessors’ Book Page 7B as Lot S26.  The appellants propose to expand a nonconforming single family dwelling via the demolition of an existing dwelling and construction of a new dwelling and shed.  The building coverage will increase from an existing 16.6% (1,598 sq. ft.) to 17.7% (1,705 sq. ft.) where a maximum of 15% is allowed.  The existing dwelling is nonconforming in that it covers 16.6% of the lot where a maximum of 15% is allowed.  The lot is nonconforming in that it contains 9,637 sq. ft. where 20,000 sq. ft. is required.   The  Zoning District is R-20. A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw. 

Appeal No. 13-037:  John P. & Jamie Selldorff, 283 Old Mountain Road, Farmington, CT  06032, c/o Michael D. Ford, Esq., P.O. Box 485, W. Harwich, MA  02671, owners of property located at 174 Eastward Road, also shown on Assessors’ Book Page 13M as Lot C53.  The appellants are requesting a Modification of Special Permit 06-138 and Modification Special Permit 12-068, issued on October 4, 2012,  to change, alter or extend a nonconforming single family dwelling via the revision of the approved location for the permitted single family dwelling. 0 feet from a Coastal Conservancy District (Flood Plain, Zone A9, el. 11) where a 50 foot setback is required, and covering 38% of the buildable upland where a maximum of 15% is allowed (48% coverage was originally approved).   Preliminary Flood Plain maps have been generated, which show for the first time, portions of the property within a Velocity Zone;  although these maps are not yet final and have not yet been adopted by the Town, the appellants are seeking to revise the location of the proposed house as a result of the information provided on the new maps.  The size of the approved footprint will remain the same.      The existing dwelling is nonconforming in that it is located within the required 50 foot setback to a Coastal Conservancy District (Flood Plain, A9 Zone, el. 10) and covers 28% of the buildable upland where a maximum of 15% is allowed.  The lot is nonconforming in that it contains 15,866 sq. ft. of buildable upland where 20,000 sq. ft. is required, and 80 linear feet of frontage where 150 feet is required.  Section 14, Powers of Board of Appeals, Authority of Board, of M.G.L., Ch. 40A, The Zoning Act, authorizes the Zoning Board of Appeals to reverse or affirm, in whole or in part, or modify any order or decision.  

Appeal No. 13-038:  Paul Schuyler, Box Office Café, 2642 Main St., So. Chatham, MA  02659, owner of property located at 2642 Main Street, also shown on Assessors’ Book Page 3D as Lot 11.  The appellant proposes to expand  a nonconforming retail operation (video rentals)  conducted within an existing lunchroom via the relocation of this aspect of the business from the first floor to an approximately 30 foot by 30 foot area on the second floor currently used for storage.  The retail operation is nonconforming in that retail sales are not an allowed use in an SB (Small Business) Zoning District. The property contains 16,345 sq. ft. in an SB Zoning District. Additionally proposed is an increase in seating in the existing lunchroom to 49 seats.   A Special Permit is required under Section III.C.3.c., District Regulations, District Area Regulations, Uses Requiring a Special Permit and Section V.B., Nonconforming Lots, Buildings and Uses, and of the Protective Bylaw.

Appeal No. 13-039:  Paul Schuyler, Box Office Café, 2642 Main St., So. Chatham, MA  02659, owner of property located at 2642 Main Street, also shown on Assessors’ Book Page 3D as Lot 11.  The applicant is requesting the grant of a Permit from the Sign Code Appeals Committee to replace an existing 9.77 sq. ft. ground sign with a 12.5 square foot ground sign where a maximum size of 8 sq. ft. is allowed, and to install a 3.33 sq. ft. wall sign  where a maximum of 1 sq. ft. is allowed in an SB Zoning District.  The property contains 16,345 sq. ft. in an SB (Small Business) Zoning District.   A Permit is required under Section 225-19, Appeal Permits,  of the Chatham Sign Code.      


Appeal No. 13-016:  Capri Lane Association LLC, 86 Capri Lane, Chatham, MA  02633, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633,  owners of property located at Lot C13 Capri Lane, also shown on Assessors’ Book Page 13C as Lot C13.  Continued from the March 28, 2013 and May 27, 2013 public hearings for the construction of an association pier in a Coastal Conservancy District.
