LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, November 21, 2013, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 13-070: Cathy Mock & Alysia Mock-Sweeney, 57 Great Hill Road, Chatham, MA 02633 c/o Christopher Childs, 537 Route 28, Harwich Port, MA 02646, owners of property located at 57 Great Hill Road, also shown on the Town of Chatham Assessors’ Map 13G , Lot PC9A.  The Appellants propose to expand a nonconforming single family dwelling via a 19 foot by 22 foot addition on the westerly side of the dwelling, 25.2 feet from the road where 40 feet is required and 15.5 feet from the westerly lot line where a 25 feet setback is required.  The existing single family dwelling was constructed in 1998 under Section V.D.4 Nonconforming Lots, of the Protective Bylaw as a result of the fact that the lot existed as of January 1, 1987.  The lot is nonconforming in that it is 12,848 sq. ft. where 40,000 sq. ft. is required.    The Zoning District is R-40.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-071: Mooncusser Lane LLC, 101 Depot Road, Chatham, MA 02633, owners of property located at Lot 2 Mooncussers Lane also shown on the Town of Chatham Assessor’s Map 10A, Block 4, Lot H2.  The Appellants propose to construct 267 square feet of a driveway in a Conservancy District.  The lot is 53,541 square feet and is located in an R-40 Zoning District.  A Special Permit is required under Section IV.A.3.c, Conservancy Districts, of the Protective Bylaw.

Appeal No. 13-072: Hillary Foulkes, 193 Main Street, Chatham, MA 02633 c/oThomas Butkowsky, 1054 Main Street, Chatham, MA 02633, owner of property at 193 Main Street, also shown on the Town of Chatham Assessors’ Map 16C, Block 13, Lot 51.  The Appellant proposes to alter, change or expand a nonconforming multi-use building on a nonconforming lot via the construction of a dormer on the second floor within the existing footprint 19.5 feet from the street where a 25 foot setback is required.  The existing building is non-conforming in that it is located 2.5 feet from the street where 25 feet is required and 6.8 feet from the side street where 25 feet is required.  The existing lot is nonconforming in that it contains 14,576 square feet where 20,000 is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw. 

Appeal No. 13-073: Robert W. Johnson and Christine W. Johnson, 26 Waterford Circle, The Woodlands, Texas, 77381, c/o William G. Litchfield, Esq., 330 Orleans Rd., N. Chatham, MA 02650, owners of property at 104 School Street, also shown on the Town of Chatham’s Assessor’s Map 16C, Block 29, Lot 7A.  The Appellants propose to alter, change or expand a nonconforming single family dwelling on a nonconforming lot via the construction of a dormer on the second floor within the existing footprint but within the street setback.  The existing dwelling is nonconforming in that it is located 13 feet from the street where 25 feet is required.  The lot is nonconforming in that it contains 12,832 square feet +/- where 20,000 square feet is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-074: Frank and Carole Fechteler, P.O. Box 8 Canaan, CT 06018, owners of property at 38 Blackberry Lane, also shown on the Town of Chatham’s Assessor’s Map 15D, Block 30 Lot 99-O-R.  The Appellants propose to expand a nonconforming single family dwelling via the demolition of an existing dwelling and construction of a new dwelling.  The new dwelling is proposed to be located 13 feet from the eastern lot line where 15 feet is required and 13 feet from the southern lot line where 15 feet is required.  The existing dwelling is nonconforming in that it is located 6 feet from the eastern lot line where 15 feet is required and 10 feet from the southern lot line where 15 feet is required.  The lot is nonconforming in that it contains 13,244 +/- square feet where 20,000 is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change, of the Protective Bylaw.

Appeal No. 13-060:  Edward & April Hovsepian, 25 Pond Brook Circle, Weston, MA  02493, c/o William F. Riley, Esq., P.O. Box 707, Chatham, MA  02633, owners of property located at 446 Old Harbor Road, also shown on Assessors’ Book Page 16G as Lot K2.  Continued from October 17, 2013.
Appeal No. 13-021: 11 Shattuck Place – Modification of decision from March 28, 2013 to clarify the record.
