LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, November 19, 2015, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-072: Benjamin and Heather Morgan, c/o William F. Riley, Esq., 154 Crowell Road, Box 707, Chatham, MA  02633, agreed vendee of property located at 398 Cedar Street, also shown on the Town of Chatham’s Assessors’ Map 11B Block 16 Lot 12.    The Applicant propose to modify Special Permit No. 12-090, granted on October 25, 2012, which allowed the Applicant to demolish the main dwelling and garage and construct a new dwelling and garage. No change is proposed to the guest house. The Applicant now seeks to modify Special Permit No. 12-090 to allow for an alteration in design and to include a pool.  Prior to demolition, the existing dwelling was nonconforming in that it was located 9.6 feet from the road where a 40 foot setback is required.  The proposed dwelling will be nonconforming in that it will have a road setback of 17.3 feet where 40 feet is required.  Prior to demolition, the existing building coverage was 7.6% and the proposed building coverage is 9.5% where 10% is the maximum allowed.  Prior to the demolition of the main dwelling, the lot was nonconforming as it contained a main dwelling and a guest house on 40,918 square feet of land area where 60,000 square feet is required in an R-40 Zoning District.  A Special Permit is required Section V.B. of the Chatham Protective Bylaw.

Application No. 15-073: Stephen F. and Mary B. Keating, c/o William F. Riley, Esq., 154 Crowell Road, Box 707, Chatham, MA  02633, owner of property located at 41 Wood Carver Knoll, also shown on the Town of Chatham’s Assessors’ Map 11D Block 25 Lot B.    The Applicants propose to change, alter, and expand a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it has a road setback of 24.8 feet where 25 feet is required, is approximately 45.8 feet setback from the Conservancy District where 50 feet is required, and has a building coverage of 10.8% where 10% is the maximum allowed.  The proposed dwelling is nonconforming as it will have a building coverage of 12.6% where 10% is allowed.  The lot contains 56,200 square feet with 30,500 square feet of upland and is nonconforming as it contains 50 feet of frontage where 100 feet is required in the R-20 Zoning District.  A Special Permit is required Section V.B. of the Chatham Protective Bylaw.

Application No. 15-074: CBI Owner LLC, c/o Andrew L. Singer, Esq., Box 67, Dennisport, MA  02639, owner of property located at 296 Shore Road and 0 Claflin Landing, also shown on the Town of Chatham’s Assessors’ Map 16E Block 11 Lot F1 and Map 16E Block 11B Lot F13.    The Applicant is seeking an Amendment to the Special Permit granted in Appeal No. 08-002 in accordance with Sections IV. A. 6. C, V.B. and VIII.D.2.b of the Chatham Protective Bylaw and M.G.L. Chapter 40A, Section 6, in order to further alter, extend, and expand a nonconforming use (hotel) by adding a 50 foot landward extension to an existing seasonal pier to reflect the new location of mean high water.  The proposed pier extension will replace an elevated walkway that was temporarily installed this season to deal with the erosion that prohibited access to the pier, ramp, and float at high tide.  The proposed pier extension is located wholly within the Coastal Conservancy District and the Zoning District is R-40.  

Application No. 15-075: Garrett and Pam Sickles, c/o Stephen Hart, Stephen Hart Building Design, Box 730, West Chatham, MA  02669, owners of property located at 24 East Road, also shown on the Town of Chatham’s Assessors’ Map 2B Block 11 Lot K44.    The Applicants propose to change, alter, and expand a dwelling on a nonconforming lot via the additions of a 20 foot by 10 foot 6 inch dining room, a 20 foot by 10 foot 6 inch screened porch, and new 4 foot by 7 foot porch.  The existing dwelling has a conforming building coverage of 1,261 square feet (12.6%) but the proposed dwelling will have a nonconforming building coverage of 1,709 square feet (17.1%) where 15% is the maximum allowed thereby creating a new nonconformity.  The shed is nonconforming in that it has a southerly abutter’s setback of approximately 2 feet where 5 feet is required.  The lot is nonconforming in that it contains 10,000 square feet where 20,000 square feet is required in an R-20 Zoning District.  A Special Permit is required under Section V.B.  and a Variance is required under Section VIII D. 2 c. of the Chatham Protective Bylaw 

Application No. 15-076: Donald and Roberta Jamieson, c/o Stephen Hart, Stephen Hart Building Design, Box 730, West Chatham, MA  02669, owners of property located at 19 Blackberry Lane, also shown on the Town of Chatham’s Assessors’ Map 15D Block 27 Lot 103.    The Applicants propose to change, alter, and expand a nonconforming dwelling on a nonconforming lot via the addition of a 9 foot by 18 foot porch.  The existing dwelling is nonconforming in that it has a road setback of 20.5 feet where 25 feet is required, an easterly abutter’s setback of 12.1 feet where 15 feet is required.  The shed is nonconforming in that it is located on the northerly property line where a 5 foot setback is required.   The proposed dwelling will be nonconforming in that it will have a road setback of 22.1 feet where 25 feet is required.  The existing building coverage is nonconforming at 1,375 square feet (21.6%) and the proposed building coverage will be nonconforming at 1,537 square feet (24.2%) where the maximum allowed is 15%.   The lot is nonconforming in that it contains 6,360 square feet where 20,000 square feet is required in an R-20 Zoning District.  A Special Permit is required under Section V.B. of the Chatham Protective Bylaw.
