Brief presentation and discussion of draft Historic Incentive Bylaw with Aly Sabatino, Principal Planner

Application No. 20-081: Katama Point LLC, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 68 Shell Drive, also shown on the Town of Chatham’s Assessors’ Map 14K Block 7 Lot W50.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the relocation of a portion of the existing dwelling and conversion into a guest quarters and the construction of a new dwelling and swimming pool.  Also proposed is the installation of a new driveway as allowed by Special Permit under Section IV.A.3.d.  The existing dwelling is nonconforming in that it is located entirely within the Coastal Conservancy District (Flood Plain ele. 11).  The proposed guest quarters and new dwelling will be nonconforming in that they will be located within the Coastal Conservancy District where a 50 foot setback is required.   The existing building coverage is 3,697 square feet (43.7%) and the proposed building coverage is 7,635 square feet (90.3%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 8,455 square feet of contiguous building upland where 20,000 square feet is required for a single dwelling.  The lot contains 120,100 square feet in the R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Chatham Protective Bylaw. Continued from December 17, 2020, January 28, 2021, and March 11, 2021.

Application No. 21-022: 517 Stony Hill Road, LLC, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 517 Stony Hill Road, also shown on the Town of Chatham’s Assessors’ Map 15I Block 13 Lot 21. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling, pool and pool house located within the Inland Conservancy District, road and abutter setbacks.  Also proposed is the installation of a fence and unpaved path which requires the grant of a Special Permit IV.A.3.a. of the Protective Bylaw.  The existing dwelling is nonconforming in that it is located within the Inland Conservancy District and is located 1.4 feet from the road where a 40 foot setback is required and 6.4 feet from the easterly abutter where a 25 foot setback is required.  The proposed dwelling will comply with road and abutter setback requirements.  The proposed pool and pool house will be nonconforming in that they will be located within the Inland Conservancy District where a 25 foot setback is required.  The existing building coverage is 3,861 square feet and the proposed building coverage is 2,877 square feet where 2,950 square feet is the maximum allowed.  The lot is nonconforming in that it contains 39,011 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Chatham Protective Bylaw. 

Application No. 21-023: Eric and Maria M. Paone, owners of property located at 7 Sabins Lane, also shown on the Town of Chatham’s Assessors’ Map 15H Block 72 Lot R1. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of a portion of the dwelling and the construction of an addition.  The proposed addition will comply with road and abutter setback requirements.  The existing building coverage is 1,650 square feet (16.4%) and the proposed building coverage is 1,752 square feet (17.4%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,065 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw. 

Application No. 21-024: Bridget B. Buff and Robert W. Buff, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 232 Woodland Way, also shown on the Town of Chatham’s Assessors’ Map 11K Block 23 Lot HC93.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition.  The existing dwelling is nonconforming in that it is located 24.4 feet from the northerly abutter.  The proposed addition will be nonconforming in that it will be located 24.3 feet from the northerly abutter where a 25 foot setback is required.  The existing building coverage is 2,384 square feet (7.9%) and the proposed building coverage is 2,506 square feet (8.3%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 84.44 feet of frontage where 150 feet is required and contains 30,239 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 21-026: Bruce and Marla Viekman, c/o Peter Farber, PO Box 768, North Chatham, MA, 02650, owners of property located at 198 Training Field Road, also shown on the Town of Chatham’s Assessors’ Map 9I Block 22 Lot SW36. The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the construction of additions.  The proposed additions will comply with all bulk and dimensional requirements of the Bylaw but are considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The existing building coverage is 1,407 square feet and the proposed building coverage is 2,662 square feet where 2,850 square feet is the maximum allowed.  The lot is nonconforming in that it contains 20,500 square feet in the R60 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw. 

Application No. 21-029: Jessica Guo and Philip Chu, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 73 Kent Road, also shown on the Town of Chatham’s Assessors’ Map 12J Block 26 Lot G4.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling, garage, shed and pool and the construction of a new dwelling and pool.  The existing dwelling is nonconforming in that it is located 10 Coastal Conservancy District and 22.8 feet from an unnamed way.  The existing pool is nonconforming in that it is located 3 feet from the Coastal Conservancy District.  The existing garage is nonconforming in that it is located 20.4 feet from the southwesterly abutter where a 25 foot setback is required.  The proposed dwelling will be nonconforming in that it will be located 8 feet from the Coastal Conservancy District and the proposed pool will be nonconforming located 27 feet from the Coastal Conservancy District where a 50 foot setback is required.  The existing building coverage is 2,933 square feet and the proposed building coverage is 2,990 square feet where 3,000 square feet is the maximum allowed.  The lot contains 43,500 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.
