LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, August 27, 2015, starting at 3:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Appeal No. 13-078: Douglas and Kim Burcin, owners of property located at 231 Eastward Road, also shown on the Town of Chatham’s Assessors’ Map 13M, Block 27, Lot C43. The appellants seek to extend the Special Permit No. 13-078 for two years.  The current expiration date is December 18, 2015, and the proposed expiration date is December 18, 2017.  Special Permit No. 13-078 allowed the Appellants to construct two second floor dormers on the west side of the dwelling and an addition of a second floor balcony on the north side.  The existing dwelling is nonconforming in that it is located 28 feet from Eastward Road where 40 feet is required and 28 feet from the Conservancy District where 50 feet is required.  The existing lot is nonconforming in that it contains 23,106 square feet where 40,000 square feet is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-043: Patrick and Sandra Kuter, c/o Stephen Hart, PO Box 730, West Chatham, MA 02669, owners of property located at 76 Mill Creek Road,  also shown on the Town of Chatham’s Assessors’ Map 3C Block 30 Lot M4.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a one story addition with entryway and farmers porch.  The existing dwelling is nonconforming in that it has a northerly abutter’s setback of 10.9 feet where 15 feet is required.  The proposed addition complies with setbacks.  The existing building coverage is 718 square feet (6.8%), and the proposed building coverage is 1,218 square feet (11.5%), where 15% is allowed.  The lot is nonconforming in that it contains 10,595 square feet where 20,000 square feet is required in an R-20 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-044: Anne Katsiroubas, c/o Peter Campbell, 44 Highbank Road, South Dennis, MA  02660, owner of property located at 139 Vineyard Avenue,  also shown on the Town of Chatham’s Assessors’ Map 10D Block 87 Lot D118.  The Applicant seeks to enlarge, extend, or change a dwelling on a nonconforming lot via the construction of a 336 square foot one story addition and 80 square foot deck.  The existing dwelling and the proposed dwelling will conform to the required setbacks.  The existing building coverage is 991 square feet (8.2%), and the proposed building coverage is 1,351 square feet (11.2%), where 15% is allowed.  The lot is nonconforming in that it contains 12,051 square feet where 20,000 square feet is required in an R-20 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-045: Julie Tammi, c/o oldCape Sotheby’s International Realty, 1455 Main Street, Chatham, MA  02633, tenant of the property located at 1455 Main Street, also shown on Assessors Map 10E, Block 38, Lot R2.  The Applicant is requesting the grant of a Permit by the Sign Code Appeals Committee to place a 12 inch by 48 inch wall sign on the existing building which already has a permitted wall sign.  In the Chatham Sign Code, Section 225-24 B. states “One single- or double-faced sign per property advertising an allowed business use which shall not exceed six square feet per face.”    The Zoning District is Small Business (SB) and the lot contains 27,878 square feet where 20,000 square feet is required.   An Appeals Permit is sought under Section 225-19 of the Chatham Sign Code.

Application No. 15-046: 302 Seapine, LLC,  c/o Michael D. Ford, Esq., 72 Main Street, Box 485, West Harwich, MA  02671, owner of property located at 302-304 Seapine Road,  also shown on the Town of Chatham’s Assessors’ Map 12K Block 10 Lot HC29.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling.  The existing dwelling is nonconforming in that it has a westerly abutter setback of 19.2 feet where 25 feet is required.  The existing guesthouse is nonconforming in that it has 3 bedrooms where a maximum of 2 bedrooms is allowed pursuant to Section VII Special Regulations 12.c.  The proposed dwelling will have a westerly abutter’s setback of 26 feet, thereby bringing it into conformance.  The guesthouse and lot will continue to be nonconforming.  The existing building coverage is 4,792 square feet (7.4%) and the proposed building coverage is 3,864 square feet (6%) where 10% is the maximum allowed.  The lot is nonconforming as to lot shape at 149.5 feet where 150 feet is required. The lot contains 68,111 square feet where 40,000 square feet is required in an R-40 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-047: Eastward Company, c/o William F. Riley, Esq., 156 Crowell Road, Box 707, Chatham, MA  02633, agreed vendee of property located at 78 Crowell Road,  also shown on the Town of Chatham’s Assessors’ Map 13F Block 29 Lot H14.  The Applicant seeks to enlarge, extend, or change a nonconforming use of two (2) medical Offices and three (3) apartments in a pre-existing nonconforming building to five (5) free-standing single family dwellings on a single property, pursuant to the provisions of Section V.B. and Section I.C. in that the proposed use is substantially similar in size, operation, impacts and other proposed characteristics to permitted uses specifically listed in the district.  The existing road setback is 47.7 feet and the proposed road setback is 35 feet where 50 feet is required.  The existing building coverage is 2,529 square feet (4.3%) and the proposed building coverage is 20,128 square feet (34.2%) where there is no requirement.   The lot contains 58,781 square feet where 10,000 square feet is required in an GB-3 Zoning District.  A Special Permit is required under Section V.B. and I.C., of the Chatham Protective Bylaw.
