LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, August 13, 2015, starting at 3:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-040: David M. Haas, Trustee, Cuppa Realty Trust, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 25 Pine Bluff Road, also shown on the Town of Chatham’s Assessors’ Map 2A Block 63 Lot W1.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the reconstruction and expansion of existing decks.  The expanded decks as proposed will be dimensionally conforming, but the decks will be constructed from impervious materials and will thereby increase building coverage.  Existing building coverage is 2,632 square feet (15.1%), proposed building coverage is 3,142 square feet (18%) where 15% is maximum allowed.  The lot is nonconforming in that it contains 17,457 square feet where 20,000 square feet is required in the R-20 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-042: David M. Haas, Trustee, Cuppa Realty Trust, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 29 Pine Bluff Road, also shown on the Town of Chatham’s Assessors’ Map 2A Block 65 Lot W3.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an extension of the deck at the southeast corner of the dwelling, reconstruct a smaller deck and relocate the stairs further from the Coastal Conservancy District.  The existing deck is 24.1 feet from the sideline setback from the easterly abutter’s setback, and the proposed change will decrease the setback to 23.4 feet where 25 feet is required.  Stone piers and a façade are proposed to be added to the dwelling along its southerly face, and one nonstructural pier will protrude into the Coastal Conservancy District, but its bottom will end before the ground.  In addition, architectural details of the roof will be changed, as will existing dormer configuration, and a second floor balcony over an existing deck will be added, thereby increasing building coverage from 2,800 square feet (26.4%) to 2,940 square feet (27.7%) where 15% is allowed.  The dwelling is nonconforming in that it is located 13.8 feet from the road setback where 25 feet is required, 6.2 feet from the northerly abutter’s setback where 15 feet is required, and 0 feet from the Coastal Conservancy District where 50 feet is required.    The lot is nonconforming in that it contains 15,184 square feet and 10,600 square feet of buildable upland where 20,000 of each is required, and contains 25.81 feet of frontage where 100 feet is required in the R-20 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-038: Frank & Susan Pinto, c/o Michael D. Ford, Esq., 72 Main Street, Box 485, West Harwich, MA  02671, owner of property located at 171 Queen Anne Road, also shown on the Town of Chatham’s Assessors’ Map 14E Block 16 Lot 12.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the raising of the existing dwelling onto a new foundation and construct a new 534 square foot addition.  The existing dwelling is nonconforming in that it has an easterly abutter’s setback of 23.1 feet where 25 feet is required and a road setback of 33.2 feet where 40 feet is required.   The proposed dwelling will not create any new nonconformities. The existing building coverage is 1,139 square feet (10.18%) and the proposed dwelling will have a building coverage of 1,677 square feet (14.96%).  The lot is nonconforming in that it contains 78.97 feet of frontage where 150 feet is required, and contains 13,566 square feet where 40,000 square feet is required in the R-40 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-039: A. Nelson Long, Jr., Trustee, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 288 Training Field Road, also shown on the Town of Chatham’s Assessors’ Map 9J Block 29 Lot 1.  The Applicant seeks to construct a new dwelling on a nonconforming lot.  The Applicant seeks a modification of Special Permit No. 10-086, to construct a dwelling in a different location than that approved on November 18, 2010, which Special Permit is still viable under the Permit Extension Act, Section 173 of Chapter 240 of the Acts of 2010, as amended.  The proposed new dwelling will comply with the dimensional requirements of the Protective Bylaw.  The lot is nonconforming in that it contains 22,162 square feet where 60,000 square feet is required in the R-60 Zoning District.  The proposed building coverage is 1,344 square feet (6.1%) where 2,850 square feet is the maximum allowed.   A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-031: Janet Gove Dugan, Trustee, Janet Gove Dugan Trust, c/o Andrew Singer, Esq., 26 Upper County Road, P. O. Box 67, Dennisport, MA 02639, owner of property located at 0 and 16 Little Beach Road, also shown on the Town of Chatham’s Assessors’ Map 16A Block 38A Lot H40 and Map 16A Block 35 Lot H41.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is wholly within the Coastal Conservancy District where a 50 foot setback is required.  The existing dwelling is also nonconforming in that it has a road setback of 35.9 feet where 40 feet is required, a westerly abutter’s setback of 24.8 feet where 25 feet is required, a southerly abutter’s setback of 14 feet where 25 feet is required, and a ridge height of 20.03 feet where 20 feet is the maximum.  The original lot is nonconforming in that it contains 6,049 square feet where 40,000 square feet is required and contains 0 square feet of buildable upland where 20,000 square feet is required but the lot will become less nonconforming when the vacant abutting lot (Lot 40A) is added to the existing lot. The proposed dwelling will have a road setback of 33 feet (covered front stoop) where 40 feet is required, a westerly abutter’s setback of 16 feet where 25 feet is required and the ridge height will be 29 feet where 20 feet is the maximum allowed.   The two lots combined will be 10,705 square feet where 40,000 square feet is required within the R-40 Zoning District.  A Special Permit is required under Sections IV and V.B., of the Chatham Protective Bylaw and M.G.L. Chapter 40A, Section 6.  Continued from July 23, 2015.
