ZONING BOARD OF APPEALS

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, September 11, 2014, starting at 3:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-058: Mark and Katherine A. Donovan, c/o James M. Norcross, Esq., 154 Crowell Road, Chatham, MA  02633, owner of property located at 576 Fox Hill Road, also shown on the Town of Chatham’s Assessors’ Map 12M, Block 7, Lot P3. The appellants seek to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the construction of a 135 square foot addition onto the northeast side of the existing dwelling.  The proposed addition will be 47 feet from the Conservancy District where 50 feet is required.  The proposed addition will meet all dimensional setbacks and the building coverage will be 7.7% where 10% is the maximum.  The existing dwelling is nonconforming in that it is located 18 feet from the Conservancy District where 50 feet is required, and has a road setback of 39.9 feet where 40 feet is required.  The lot is nonconforming in that it contains 39,159 square feet where 40,000 is required and has 107.68 feet of frontage where 150 feet is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-059: Amanda C. and William P. Madar, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 31 Thayer Lane, also shown on the Town of Chatham’s Assessors’ Map 16G, Block 6, Lot K4. The appellants seek to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the conversion of approximately 90 square feet of existing deck (on piers) to first floor living space, and the construction of approximately 23 square feet of additional deck, also elevated, within the Coastal Conservancy District where 50 feet is required.  Also proposed is the construction of a planter and reconfiguration of existing stairs within the Coastal Conservancy District where 50 feet is required.  The existing structure is nonconforming in that it is located partially within the Coastal Conservancy District where a 50 foot setback is required.  The existing building coverage is 2,676 square feet (56.7%), the proposed building coverage is 2,766 square feet (58.6%) where 10% is allowed.  The lot is nonconforming in that it contains 4,717 square feet of buildable upland where 20,000 square feet is required.  The lot contains 42,000 square feet.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-060: Thomas and Laurie Baldwin, c/o William F. Riley, Esq., P.O. Box 707, Chatham, Ma 02633, owners of property located at 123 Strong Island Road, also shown on the Town of Chatham’s Assessors’ Map 13M, Block 54, Lot B14. The appellants seek to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the construction of a porch addition with second floor reconstruction, relocation of a shed, dormers on to the second floor, and pool.  The existing dwelling is nonconforming in that it is within 10 feet of the Conservancy District where 50 feet is required.  The proposed porch and second floor reconstruction will be 45 feet from the Conservancy District where 50 feet is required.  The existing building coverage is 3,337 square feet (10.4%) of the buildable upland and the proposed building coverage will be 3,369 square feet (10.5%) where 10% is allowed.  The exterior mechanical system appliance (pool) will be 25 feet from the abutter’s setback where 25 feet is required.  The lot contains 1.059 acres and is located within the R-40 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-061: Donna Sedita, c/o Peter S. Farber, PO Box 768, North Chatham, MA  02650, owner of property located at 341 Pleasant Street, also shown on the Town of Chatham’s Assessors’ Map 2A, Block 29, Lot T7A. The appellant seeks to change, alter, or expand a nonconforming dwelling on a nonconforming lot via demolishing the existing dwelling and constructing a new dwelling.  The existing dwelling is nonconforming as it is 1.76 feet setback from the road and the proposed dwelling will be 9.9 feet setback from the road with a front canopy 5.4 feet setback from the road where 25 feet is required.  The existing dwelling is 11.86 feet from the northerly abutter’s setback and the proposed dwelling will be 18.1 feet abutters’ northerly setback where 15 feet is required.  The existing dwelling is 8.97 feet from the easterly abutter’s setback and the proposed dwelling is 6.1 feet from the easterly abutter’s setback where 15 feet is required.  The lot is nonconforming as it contains 9,476 square feet when 20,000 square feet is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-066: Town of Chatham, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 702 Main Street, also shown on the Town of Chatham’s Assessors’ Map 14E, Block 0, Lot 27. The appellant seeks to change, alter, or expand a nonconforming structure (the ball field lights) via the replacement of eight existing light poles approximately 70 feet in height with eight poles of approximately 80 feet in height where the maximum allowed is 30 feet.  The existing poles service the lights at Veterans Field; the proposed replacement poles will provide the same service at approximately the same locations.  Alternatively, appellant seeks a variance to exceed the maximum allowable height under the Protective Bylaw.  The lot is 10.91 acres where there is no requirement for lot size.  The Zoning District is Municipal (M).  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw and a Variance is required under Section VIII D.2.c. of the Chatham Protective Bylaw.  

Appeal No. 14-037: Robert Michael, LLC, 10 Seacrest Village, Chatham, MA  02633, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 59 Seaview Street, also shown on the Town of Chatham’s Assessors’ Map 15E, Block 9, Lot 18. The appellant proposes to demolish three existing structures and construct two new dwellings.  The existing use is nonconforming in that it contains multiple dwellings where one is allowed.  One existing dwelling is nonconforming in that it has setbacks of 24.4 feet from the road where 25 feet is required.  The existing building coverage is 2,303 square feet (10.1%), the proposed building coverage is 3,413 square feet (15%) where the maximum allowed is 2,900 square feet thereby creating a new nonconformity. The proposed dwellings will meet the setback requirements of the Zoning District.  The Zoning District is R-20.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.  To be remanded by the Court for a hearing on the proposed modified decision.

Appeal No. 14-057: Robert Samuelson and Kristin Campbell, c/o William F. Riley, Esq., 154 Crowell Road, Chatham, MA  02633, owner of property located at 138 Stage Island Road, also shown on the Town of Chatham’s Assessors’ Map 14A1, Block 5, Lot D20. The appellants seek to modify Special Permit No. 11-052 to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 37.4 feet from the road setback where 40 feet is required and 20.7 feet from the abutter’s setback where 25 feet is required.  The lot is nonconforming in that it contains 32,000 square feet where 40,000 is required.  The proposed building coverage is 3,741 square feet (15%) where the maximum building coverage is 2,900.  The proposed dwelling will be 24 feet from the road setback where 40 feet is required and 23.4 feet from the abutter’s setback where 25 feet is required.  The proposed retaining wall exceeds the 3 foot requirement and does not meet setback requirements of 40 feet from the road and 25 feet from the abutters.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  Continued from August 28, 2014.
