LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, August 28, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-053: Minglewood Homes, Inc. , c/o Timothy R. Smith, 1281 Main Street, Chatham, MA  02633, owner of property located at 606 Orleans Road, also shown on the Town of Chatham’s Assessors’ Map 12J, Block 24, Lot GD.  The appellants seek to modify Special Permit No. 13-049 and No. 12-036 to relocate the dwelling 5 feet landward from what was previously approved.  The proposed dwelling is located in the Coastal Conservancy District where a setback of 50 feet is required.   The existing northerly abutter’s setback is 30.9 feet and the proposed northerly abutter’s setback is 29.8 feet where 25 feet is required.  The existing southerly abutter’s setback is 10.8 feet and the proposed southerly abutter’s setback is 13.5 feet where 25 feet is required.  The existing road setback is approximately 117 feet and the proposed road setback is 87.8 feet where 40 feet is required.  The lot is nonconforming in that it contains 32,197 square feet, with 15,525 square feet of buildable upland, where 40,000 is required.  The Zoning District is R-40.  A Special Permit is required under Section VIII. D.2.b. and Section IV of the Chatham Protective Bylaw.  

Appeal No. 14-055: Francis and Ann Kelly, c/o Larry Brutti, Fore and Aft, Inc., Box 92, Harwich Port, MA  02646, owner of property located at 55 Tanglewood Drive, also shown on the Town of Chatham’s Assessors’ Map 4H, Block 6D, Lot T21. The appellants seek to construct an addition onto a dwelling on a nonconforming lot.  The lot is nonconforming in that it contains 22,668 square feet where 60,000 is required, and contains 120 feet of frontage where 150 feet is required.  All dimensional requirements are met.  The proposed addition will be approximately 15 feet by 32 feet, containing 480 square feet.  The Zoning District is R-60.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-056: Derek and Wendy Upson and Christopher and Candace Bignell, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 75 Hardings Lane, also shown on the Town of Chatham’s Assessors’ Map 14C, Block 32, Lot 23A. The appellants seek to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 25.3 feet from the right-of-way used for access where 40 feet is required.  The lot is nonconforming in that it has 0 feet of frontage where 150 feet is required, and contains 35,535 square feet where 40,000 square feet is required.  The proposed dwelling will be located 23.1 feet from the easterly abutter’s setback where 25 feet is required, thereby creating a new nonconformity, and 25.3 feet from the right-of-way used for access where 40 feet is required.  Existing height is 17.3 feet and proposed height is 29.3 feet.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-057: Robert Samuelson and Kristin Campbell, c/o William F. Riley, Esq., 154 Crowell Road, Chatham, MA  02633, owner of property located at 138 Stage Island Road, also shown on the Town of Chatham’s Assessors’ Map 14A1, Block 5, Lot D20. The appellants seek to modify Special Permit No. 11-052 to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 37.4 feet from the road setback where 40 feet is required and 20.7 feet from the abutter’s setback where 25 feet is required.  The lot is nonconforming in that it contains 32,000 square feet where 40,000 is required.  The proposed building coverage is 3,741 square feet (15%) where the maximum building coverage is 2,900.  The proposed dwelling will be 24 feet from the road setback where 40 feet is required and 23.4 feet from the abutter’s setback where 25 feet is required.  The proposed retaining wall exceeds the 3 foot requirement and does not meet setback requirements of 40 feet from the road and 25 feet from the abutters.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.
