LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, July 9, 2015, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-032: Peter and Margaret Mullin, c/o Mark R. Zibrat, Zibrat & McCarthy Designs, 63 Crowell Road, Chatham, MA  02633, owner of property located at 303 Old Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 15G Block 26 Lot 23.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it has a northeasterly abutter’s setback of 18.2 feet where 25 feet is required.  The proposed dwelling has a northeasterly abutter’s setback of 14.9 feet where 25 feet is required.  Also, the proposed Exterior Mechanical System Appliance (AC unit) will have a northeasterly abutters setback of 13 feet where 25 feet is required.  The proposed dwelling will comply with the other setback requirements, height restriction and building coverage restrictions.  The existing building coverage is 926 square feet (9.2%) and the proposed building coverage is 1,068 square feet (10.9%) where 15% is the maximum allowed.   The lot is nonconforming in that its frontage is 68.73 feet where 150 feet is required.  The lot contains 10,092 square feet where 40,000 square feet is required in the R-40 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-033: Robert L. and Marilyn E. Cunningham, c/o William G. Litchfield, Esq., 330 Orleans Road, Chatham, MA  02650, owners of property located at 39 Bay View Road, also shown on the Town of Chatham’s Assessors’ Map 3C Block 19 Lot M8.  The Applicant proposes to expand a nonconforming dwelling on a nonconforming lot via the addition of a second story, with dormer, to be constructed above the existing structure.  The proposed addition will comply with the dimensional requirements of the Protective Bylaw, but is considered a substantial alteration to a nonconforming dwelling, and under the Second Except Clause of M.G.L. Chapter 40A Section 6, a Special Permit is required.  In addition, the existing deck is nonconforming in that it is located 13.8 feet from the easterly abutters lot line where 15 feet is required; the lot is nonconforming in that it contains 8,041 square feet where 20,000 is required in the R-20 Zoning District.  The existing building coverage is 946 square feet (11.8%) and the proposed building coverage is 1,206 square feet (15%) where 15% is the maximum allowed.   A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-034: Gilbert Wilson, 1550 Main Street, Chatham, MA  02633, owner of the property located at 1550 Main Street, also shown on Assessors Map 9E, Block 6, Lot 7.  The Appellant is requesting the grant of a Permit by the Sign Code Appeals Committee to place a 72 inch by 24 inch wall sign on the existing building.  The proposed sign is in addition to the existing ground sign of 24 inches by 36 inches.  In the Chatham Sign Code, Section 225-24 B. states “One single- or double-faced sign per property advertising an allowed business use which shall not exceed six square feet per face.”   The Zoning District is Small Business (SB) and the lot contains 13,578 square feet where 20,000 square feet is required.   An Appeals Permit is sought under Section 225-19 of the Chatham Sign Code.

Application No. 15-035: James C. and Jennifer D. Larwood, c/o Andrew Singer, Esq. 26 Upper County Road, P. O. Box 67, Dennisport, MA 02639, owners of property located at 39 Pine Grove Road, also shown on the Town of Chatham’s Assessors’ Map 8B Block 11 Lot H64.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a covered porch on the westerly side of the dwelling and an addition to the attached garage.  The existing dwelling is nonconforming in that it has a southerly abutter’s setback of 14.8 feet where 15 feet is required, but other setbacks comply with the Protective Bylaw.  The proposed setbacks will comply with the Protective Bylaw.  The existing building coverage is 1,777 square feet (15%) and the proposed building coverage is 2,196 square feet (18.6%) where 15% is the maximum allowed.   The lot is nonconforming in that it contains 11,816 square feet where 20,000 square feet is required in the R-20 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-027: Stephen and Maureen Hadded, c/o William F. Riley, Esq., 156 Crowell Road, Box 707, Chatham, MA  02633, owners of the property located at 19 Forest Bluffs Road, also shown on the Town of Chatham’s Assessors’ Map 3A Block 8 Lot D1.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it has a setback of 29 feet from the Conservancy District where 50 feet is required.  The lot is nonconforming in that its frontage is 99.70 feet where 100 feet is required.  The proposed dwelling will be setback 33 feet from the Conservancy District where 50 feet is required.  The proposed dwelling will comply with other setback, height, and building coverage requirements.  The existing building coverage is 1,308 square feet (9.4%) and the proposed building coverage is 1,755 square feet (12.6%) where 15 % is allowed.  The lot contains 22,760 square feet where 20,000 square feet is required and is located within the R20 zoning district.  A Special Permit is required under Section VB of the Chatham Protective Bylaw.  Continued from June 11, 2015 for re-advertising.
