The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, January 12, 2017, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-094: Stephen and Maureen Haddad, c/o Stephanie Sequin, Ryder & Wilcox, Inc., PO Box 439, South Orleans, MA  02662, owners of the property located at 19 Forest Bluffs Road, also shown on the Town of Chatham’s Assessors’ Map 3A Block 8 Lot D1.  The Applicants seek to demolish an existing stairway and construct a new stairway 4.6 feet from the westerly abutters setback.   The total lot size is 22,760 square feet and the property is located within the R20 Zoning District.  A Special Permit is required under Section IV.A.3.a. of the Chatham Protective Bylaw.  

Application No. 16-095: Ernest and Deborah Walen, c/o Richard Roy, 123A Queen Anne Road, Harwich, MA 02645, owner of property located at 43 Shattuck Lane, also shown on the Town of Chatham’s Assessors’ Map 15C Block 14 Lot 4.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of dormers and a portico within the abutters setbacks.  The existing dwelling is nonconforming in that it is setback of 21.3 feet from the road where 40 feet is required and has an easterly abutters setback of 20.3 feet where 25 feet is required.  The proposed dormers will be nonconforming in that they will be approximately 24 feet from the road where 40 feet is required and 21 feet from the easterly abutters setback where 25 feet is required.  The proposed portico addition will be nonconforming in that the will be 20.5 feet from the easterly abutters setback where 25 feet is required.  The lot is nonconforming in that it contains 28,800 square feet where 40,000 square feet is required and 14,451 square feet of buildable upland where 20,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-096: Eric Brazer and Amy Morris, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 174 Lakeview Avenue, also shown on the Town of Chatham’s Assessors’ Map 8I Block 53 Lot C184.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition and deck on the northwesterly side of the dwelling.  Also proposed, within the addition, is a family occupied one (1) bedroom guest unit.  The existing dwelling is nonconforming in that it has a road setback of 39.8 feet where 40 feet is required.  The proposed addition will be nonconforming in that it will be located 35.9 feet from the road where 40 feet is required.  The existing building coverage is 1,665 square feet (5.8%) and the proposed building coverage is 2,207 square feet (7.7%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 28,693 square feet where 60,000 square feet is required in the R60 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  The Applicant is also seeking a waiver as allowed under Section VII.B.12.d. of the additional land area requirement for a one (1) bedroom guest unit. 

Application No. 16-097: Sears Point Development, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, agreed vendee of the property located at 45 Bridge Street, also shown on the Town of Chatham’s Assessors’ Map 14A Block 11A Lot 93.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling.   The existing dwelling is nonconforming in that it is located 21.6 feet from the westerly abutter and 1.34 feet from the Coastal Conservancy District.  The proposed dwelling will also be nonconforming in that will be 21.9 feet from the westerly abutter where a 25 foot setback is required and .5 feet from the Coastal Conservancy District where a 50 foot setback is required. The existing building coverage is 1,410 square feet (33%) and the proposed building coverage is 1,799 square feet (42.1%) where 15% is the maximum allowed.  The lot is conforming in that it contains 116,360 square feet of land but is nonconforming as it contains 4,270 square feet of buildable upland where 20,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 16-098: Joseph Hannigan, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, agreed vendee of the property located at 558 Fox Hill Road, also shown on the Town of Chatham’s Assessors’ Map 11M Block 6 Lot P1.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and pool and the construction of a new dwelling and pool.   The existing dwelling and pool are nonconforming in that they are within the setback to the Coastal Conservancy District, 16.5 feet (dwelling) and 22.9 feet (pool).  The proposed dwelling and pool will continue to be nonconforming in that the dwelling will be 15.8 feet and the pool will be 11.8 feet from the Coastal Conservancy District where a 50 foot setback is required.  The existing dwelling is also nonconforming in that it has a ridge height of 35.8 feet, from average grade.  The proposed dwelling will be nonconforming with a ridge elevation of 35.7 feet, from average grade where 30 feet is the maximum allowed. The existing building coverage is 2,951 square feet (7.3%) and the proposed building coverage is 4,022 square feet (10%) where 10% is the maximum allowed.  The lot is conforming in that it contains 111,078 square feet in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.
