LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, August 11, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-052: Tara and William Dougherty, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 57 Mill Pond Lane, also shown on the Town of Chatham’s Assessors’ Map 15C Block 10 Lot 7.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a lot via the demolition of the existing dwelling and construction of a new dwelling.  The existing dwelling is nonconforming in that the garage has a road setback of 38.5 feet where 40 feet is required and a westerly abutter setback of 15.3 feet where 25 feet is required.  The proposed dwelling will meet the dimensional requirements of the bylaw, but is considered a substantial alteration of a nonconforming dwelling, and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The existing building coverage is 3,335 square feet (7.1%) and the proposed building coverage is 4,532 square feet (9.7%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 145 feet of frontage where 150 feet are required.  The lot is conforming in that it contains 49,510 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-053: Underwood Property Corporation, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owner of property located at 195 & 197 Bridge Street, also shown on the Town of Chatham’s Assessors’ Map 15B Block 3 Lot 2 and Map 15B Block 3A Lot 2A.  The Applicant seeks a Special Permit for occasional rental and use of the premises for weddings and wedding receptions, with conditions, under Section I.C. of the Bylaw.  The lots are conforming in that they contain 183,510 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under Section I.C. of the Protective Bylaw.   

Application No. 16-054: Katherine Malfa and Thomas De Lio, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of the property located at 77 Palmer Drive, also shown on the Town of Chatham’s Assessors’ Map 15G Block 38 Lot P8.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the construction of an addition, covered porches and a deck, 32 feet from the road where a setback of 40 feet is required.  The existing dwelling is nonconforming in that it has a road setback of 37.8 feet where 40 feet is required and the southeasterly abutter’s setback of 23.1 feet where 25 feet is required.  The existing building coverage is 912 square feet (9.1%) and the proposed building coverage is 1,489 square feet (14.9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,008 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 16-055: James and Jamie Pagliocco, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owners of the property located at 66 Howes Lane, also shown on the Town of Chatham’s Assessors’ Map 7B Block 51 Lot S24.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the construction of an addition to the garage on the northwest, and an addition on the southeast side of the structure.  Also proposed is the construction of an overhang, approximately 24 square feet, above the front door, 24.5 feet from the street, in accordance with Section III.D.3.f.  The structure and proposed additions will meet all other applicable setbacks for the zoning district. The existing building coverage is 1,805 square feet (19.3%) and the proposed building coverage is 2,172 square feet (23.2%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 9,375 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 16-056: Gregory and Julie McCaffery, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of the property located at 35 Inlet Road, also shown on the Town of Chatham’s Assessors’ Map 14B Block 9 Lot C3.  The Applicants seek to change, alter or extend a conforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling. Also proposed is the retention of the existing garage.  The proposed dwelling will meet all the bulk and dimensional requirements of the bylaw. The existing building coverage is 1,602 square feet (5.1%) and the proposed building coverage is 3,124 square feet (10%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 31,236 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.
