LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, March 12, 2015, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Application No. 15-006: Janet and Bill Dugan, Janet Gove Dugan Trust, c/o Theodore P. Streibert, 15 Linden Tree Lane, Chatham, MA  02633, owners of property located at 16 Little Beach Road, also shown on the Town of Chatham’s Assessors’ Map 16A Block 35 Lot H41.  The appellants seek to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is wholly within the Coastal Conservancy District where 50 feet is required.  The existing dwelling is also nonconforming in that it has a road setback of 35.9 feet where 40 feet is required, and a abutters setback of 24.8 feet where 25 feet is required, and a ridge height of 20.03 feet where 20 feet is the maximum.  The lot is nonconforming in that it contains 10,705 square feet where 40,000 square feet is required and contains 0 square feet of buildable upland where 20,000 square feet is required.  The proposed house will have a nonconforming road setback of 32 feet where 40 feet is required, an abutter’s setback of 9.5 feet where 25 feet is required, and a height of 31.6 feet where 20 feet is required.   The lot is located within the R-40 Zoning District.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Application No. 15-007: CBI Operations LLC d/b/a Chatham Bars Inn, c/o Chris Cannon, Box 201, Chatham, MA  02633, owners of property located at 390 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16F Block 21 Lot E9.  The appellants seek to install a fence with locked gate and stone bollards on sand between the beach and paved areas at Fish Pier.  The proposed fence will be installed along the southerly lot line.  The lot is wholly within the Coastal Conservancy District and is located within the R-40 Zoning District.  A Special Permit is required under Section IV of the Chatham Protective Bylaw.  

Application No. 15-008: Nickerson Tree & Landscape, Inc., c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, agreed lessee of property located at 136 George Ryder Road, also shown on the Town of Chatham’s Assessors’ Map 8E Block 50 Lot 25.  The Applicant seeks a Special Permit to construct two residential apartments incidental to commercial use in conjunction with the construction of two commercial buildings.  The premises now contain two buildings (804 square feet and 440 square feet), one of which contains a residence.  The proposed buildings are 1500 square feet and 864 square feet; the former will contain two one-bedroom units on the 2nd floor.  The proposed 1500 square foot building is 74.3 feet from the road setback where 50 feet is required, and 16 feet from the southerly abutters setback where 15 feet is required.  The proposed 864 square foot building has a southerly abutter’s setback of 15.5 feet and an easterly abutter’s setback of 15.5 feet where 15 feet is required, and both are thus conforming as to dimensional requirements. The parking area setbacks meet the required 20 feet from the road and 15 feet from the abutter’s lot lines.  The existing green area is 35,350 SF (92%) and the proposed green area is 24,960 SF (65%) where 40% is the minimum.  The existing lot coverage is 3,240 SF (8%) and the proposed lot coverage is 13,632 square feet (35%) where 60% is the maximum allowed.    The lot is 38,594 square feet and is located within the GB3 Zoning District.  A Special Permit is required under Section VIII of the Chatham Protective Bylaw.
