LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, September 25, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-062: Joan Anne Barsamian, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 75 Holway Street, also shown on the Town of Chatham’s Assessors’ Map 17C, Block 26, Lot 22. The appellant seeks to change, alter, or expand a nonconforming dwelling on a nonconforming lot via the construction of two additions, a deck, and the raising of the existing dwelling.  The existing dwelling is nonconforming in that it has a westerly abutter’s setback of 10.7 feet where 15 feet is required and a northerly abutter’s setback of 8.9 feet where 15 feet is required.  The proposed southerly addition will have an abutter’s setback of 10.8 feet where 15 feet is required.  The proposed easterly deck will have a northerly abutter’s setback of 12.3 feet where 15 feet is required.  The proposed deck will be nonconforming in that it will be setback from the Conservancy District 10 feet when 50 feet is required, and the dining room addition will be nonconforming in that it is setback from the Conservancy District 20 feet where 50 feet is required. The existing dwelling ridge elevation is 35.5 feet; the proposed ridge elevation is 36.7 feet.  The lot is nonconforming as it contains 9,598 square feet where 20,000 square feet is required.  The Zoning District is R-20.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-063: South Cape Enterprises, Inc., c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 1062-1072 Main Street, also shown on the Town of Chatham’s Assessors’ Map 12F, Block 6, Lot XD, and Map 12F, Block 6, Lot XC, and Map12F, Block 6, Lot XB, and Map 12F, Block 7, Lot 7, and Map 12F, Block 6, Lot XA.  The appellant seeks a modification of Comprehensive Permit No. 07-018 by substituting payment of funds to the Town of Chatham Affordable Housing Trust Fund in the place of providing two affordable units and converting the Comprehensive Permit to a Special Permit.  The lot contains 71,250 + square feet where 20,000 square feet is required.  The Zoning District is Small Business (SB).  

Appeal No. 14-064: Louis P. and Elizabeth Rosenthall, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 7 Old Harbor Lane, also shown on the Town of Chatham’s Assessors’ Map 16I, Block 16, Lot 13. The appellant seeks to change, alter, or expand a nonconforming structure via the demolition of the existing nonconforming garage and construction of a new garage. The existing garage is 6.7 feet from the abutter’s setback where 25 feet is required.  The proposed garage will be 7.4 feet from the abutter’s setback where 25 feet is required.  The existing building coverage is 2,254 square feet (7.0%) and the proposed building coverage will be 2495 square feet (7.7%).    The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-065: Brian O’Leary, c/o Robert M. Perry, Cape Cod Engineering, PO Box 1517, East Dennis, MA  02641, owner of property located at 520 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16G, Block 18, Lot T1. The appellant seeks to change, alter, or expand a nonconforming structure (beach access stairway and landings) via the relocation and layout of the existing nonconforming beach access stairway and landings.  The existing and proposed stairway and landings are located within the Coastal Conservancy District where a 50 feet setback is required.  The existing beach access stairway and landings are 5 feet from the abutter’s setback where 25 feet is required, and the proposed beach access stairway and landings are 10 feet from the abutter’s setback where 25 feet is required.  The lot is 2.919 acres where 40,000 square feet is required.  The Zoning District is R-40.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw.  

Appeal No. 14-051: Mimi Jigarjian Trustee Highland Realty Trust, c/o George Reilly, 63 Brook Trial Road, Brewster, MA  02631, owner of property located at 119 Highland Ave, also shown on the Town of Chatham’s Assessors’ Map 15E, Block 56A, Lot 45A. The appellants seek to modify Special Permit No. 14-001 to allow for a second story access stair, located on the northwesterly side of the dwelling.    The existing northwesterly abutter’s setback is 16 feet and the proposed northwesterly abutter’s setback is 11.2 feet where 15 feet is required, thereby creating a new nonconformity.  The lot is 10,435 square feet and the Zoning District is R-20.  A Special Permit is required under Section V.B., of the Chatham Protective Bylaw and a dimensional Variance is required under Section VIII. D. 2. c.  of the Chatham Protective Bylaw.  Continued from August 14, 2014 for re-advertising.
