LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, April 14, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-013: 113 Seapine LLC, c/o Michael D. Ford, Esq., 72 Main Street, West Harwich, MA  02671, owner of the property located at 113 Seapine Road, also shown on the Town of Chatham’s Assessors’ Map 11K Block 32 Lot HC10.    The Applicant proposes to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling. The existing dwelling is nonconforming in that it has a road setback of 29.8 feet where 40 feet is required.  All other dimensional requirements are conforming. The proposed dwelling will become less nonconforming with a road setback of 38 feet where 40 feet is required.  The existing building coverage is nonconforming in that it is 3,342 square feet (15.2%) and the proposed building coverage will increase the nonconformity to 3,416 square feet (15.5%) where a maximum of 2,850 square feet is allowed.  The lot is nonconforming in that it contains 25,229 square feet where 40,000 square feet is required in the R-40 Zoning District.   A Special Permit is required under M.G.L Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.  

Application No. 16-014: Lynn Wright, c/o Leslie Schneeberger, 403 Main Street, Chatham, MA  02633, owner of the property located at 62 Snowberry Lane, also shown on the Town of Chatham’s Assessors’ Map 2B Block 109 Lot R64.    The Applicant proposes to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition, deck, porch and garage.   The existing dwelling and proposed additions are conforming as to dimensional setbacks.  The existing building coverage is 1,440 square feet (10.5%) and the proposed building coverage is 1,955 square feet (14.3%) where 15% is the maximum allowed.   The lot is nonconforming in that it contains 13,719 square feet where 20,000 square feet is required in the R-20 Zoning District.   A Special Permit is required under M.G.L Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.  

Application No. 16-016: Joshua Zuckerman, c/o William G. Litchfield, 330 Orleans Road, North Chatham, MA  02650, owners of the property located at 403 Old Comers Road, also shown on the Town of Chatham’s Assessors’ Map 10I Block 11 Lot 3.  The Applicant seeks to change, alter or extend a nonconforming dwelling on a nonconforming lot via the construction of a 14 foot by 24 foot addition.  The existing dwelling is nonconforming in that it is setback 29 feet from the coastal bank where 50 feet is required and setback 27.1 feet from the road where 40 feet is required.  The proposed dwelling will be setback 38 feet from the coastal bank where 50 feet is required.  Also proposed is the enclosure of an existing covered entryway and an existing porch, but neither will increase nonconformity.  The existing building coverage is 2,347 square feet (16.6%) and the proposed building coverage is 2,683 square feet (19%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 14,100 square feet of buildable upland where 20,000 square feet is required and contains 23,980 square feet where 60,000 square feet is required in an R-60 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.  

Application No. 16-017: Larry Biron, lessee of the property located at 2620 Main Street, also shown on the Town of Chatham’s Assessors’ Map 3D Block 42 Lot 9A.  The Applicant seeks an Appeals Permit under Section 225-19 of the Town of Chatham Sign Bylaw, to allow the placement of an additional 8 inch by 41 inch panel on an existing ground sign of 6 square feet, where one ground sign of 6 square feet per property is allowed.  The sign is proposed to be located on a corner lot at Main Street and Morton Road in a SB Zoning District.  A Special Permit (No. 12-029) was granted on April 12, 2012 allowing two ground signs on one property.  The proposed sign requires an Appeals Permit under Section 225-19 and Section 225-24 of the Chatham Sign Bylaw.    

Application No. 16-018: James and Michael Feeley, c/o Chris Childs, Patriot Builders, 537 Route 28, Harwich Port, MA  02646, owners of the property located at 74 Cod Lane, also shown on the Town of Chatham’s Assessors’ Map 15G Block 80 Lot B73.  The Applicant seeks to change, alter or extend a nonconforming dwelling on a nonconforming lot via the demolition of the existing garage and sunroom, and the construction of an addition and second floor.  The existing dwelling is nonconforming in that it has a road setback of 33.4 feet where 40 feet is required, and a northeasterly abutter’s setback of 20.9 feet and a southwesterly abutter’s setback of 14.5 feet where 25 feet is required.  The proposed dwelling will maintain the nonconforming setbacks.  The existing building coverage is 1,344 square feet (13%) and the proposed building coverage is 1,541 square feet (14.9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,366 square feet where 40,000 square feet is required in the R-40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6 and Section V.B. of the Chatham Protective Bylaw.  

Application No. 16-031: Erin M. O’Brien and Christian Treiber, c/o Ryan McManus, Esq., 75 State Street, Boston, MA 02109, owner of property located at 74 Mill Pond, also shown on the Town of Chatham’s Assessors’ Map 15C Block 5 Lot 12. Remand upon Appeal of Special Permit No. 15-048 granted on September 10, 2015 to add a proposed condition addressing height of a hedge on a portion of the property, along with the height of other vegetation or permanent structures on that portion of the property.
