LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, November 15, 2018, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-086: Janet Killmon, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owners of property located at 21 Hammond Lane, also shown on the Town of Chatham’s Assessors’ Map 16B Block 46 Lot 34. The Applicant seeks to extend Special Permit No. 16-086 for one year.  The current expiration date is December 13, 2018, and the proposed expiration date is December 13, 2019. Special Permit No. 16-086 allowed the Applicant to construct dormers and a second floor deck.  The existing dwelling is nonconforming in that it is located 4.7 feet from the westerly abutter and 12.1 feet from the easterly abutter where 15 feet is required from both.  The existing garage is nonconforming in that it is setback 0 feet from the easterly abutter where 15 feet is required.  The existing and proposed building coverage is 1,242 square feet (24.6%) where 15% is the maximum allowed. The lot is nonconforming in that it contains 5,056 square feet where 20,000 square feet is required in an R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 14 and Section VIII.D.2.b. of the Protective Bylaw.

Application No. 16-091: CBI 20 45 Chatham Bars Avenue LLC, c/o Matthew Kozol, Esq., 31 St. James Avenue, Suite 925, Boston, MA  02116, appealed the issuance of a Cease and Desist order of the Building Commissioner, issued on October 13, 2016 for the property located at 45 Chatham Bars Avenue, also shown on the Town of Chatham Assessors Map 15D Block 39 Lot C16.  The applicant seeks to have the Building Commissioner’s Cease and Desist Order reversed.  The property contains 34,848 square feet in an R20 Zoning District.  The Applicant appealed under Section VIII.D.2.a. Administration, Powers, Appeals, of the Town of Chatham Protective Bylaw and M.G.L Chapter 40A, Sections 8 & 15. Continued from January 26, 2017, May 25, 2017, September 28, 2017 and May 24, 2018. 

Application No. 18-086: Paul and Marybeth Riley, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 27 Striper Lane, also shown on the Town of Chatham’s Assessors’ Map 15D Block 64 Lot 27.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a partial second floor addition and the construction of dormers.  The existing dwelling is nonconforming in that it is located 16.3 feet from the Striper Lane and 13.9 feet from Mill Pond Lane where 25 feet is required. Also on the property is a detached garage located 4.9 feet from Mill Pond Lane where 25 feet is required and 13.1 feet from the westerly abutter where 15 feet is required.  The proposed second floor addition and dormers will be nonconforming in that they will be located 13.9 feet from the Mill Pond Lane where 25 feet is required. The existing building coverage and the proposed building coverage will remain 2,176 square feet (20.1%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,841 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 18-082: Deep End Property Inc., c/o Robert m. Perry, PO Box 1517, East Dennis, MA 02641, owner of property located at 64 Far End Lane, also shown on the Town of Chatham’s Assessors’ Map 15K Block 6B Lot 6.  The Applicant seeks a Special Permit for the alteration of an existing driveway within the Conservancy District.  The lot contains 1.12 acres with 0 square feet buildable upland in the R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 9 and Sections IV.A.3.d. and IV.A.6.b. of the Chatham Protective Bylaw.  Continued from October 25, 2018.

Application No. 18-087: James and Jennifer Larwood, c/o Andrew L. Singer, Esq., PO Box 67, Dennis Port, MA 02639, owners of property located at 39 Pine Grove Road, also shown on the Town of Chatham’s Assessors’ Map 8B Block 11 Lot H64.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of additions.  The existing dwelling is nonconforming as it is located 10.5 feet from the southerly abutter where a 15 foot setback is required.  The proposed additions will comply with the setback requirements of the Bylaw.  The existing building coverage is 2,145 square feet (18.2%) and the proposed building coverage is 2,260 square feet (19.1%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 11,816 square feet where 20,000 square feet is required in an R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B of the Chatham Protective Bylaw.

Application No. 18-088: 48 Oyster Pond Furlong LLC, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of the property located at 48 Oyster Pond Furlong, also shown on the Town of Chatham’s Assessors’ Map 13E Block 36 Lot R28. The Applicant proposes to change, alter, or expand a nonconforming structure and use (warehouse) on a nonconforming lot via the conversion of a portion of the existing structure into a 1-bedroom apartment.  The existing structure is nonconforming in that it is located 16.3 feet from easterly abutter where a 25 foot setback is required.  The existing and proposed building coverage is will remain nonconforming at 5,672 square feet where 2,900 square feet is the maximum allowed.  The lot is nonconforming in that it contains 23,603 square feet where 40,000 square feet is required in an R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.
