The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, August 23, 2018, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 18-062: Anne Harmon Lewis, Trustee, The Anne Harmon Lewis Revocable Trust Agreement, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 75 Hillcrest Road, also shown on the Town of Chatham’s Assessors’ Map 15H Block 52 Lot W1.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition, reconstruction and conversion of the existing garage into habitable space and the conversion of the existing porch into habitable space.  The existing dwelling is nonconforming in that it is located 4.2 feet from the easterly abutter, and 24.2 feet from the road and has two exterior mechanical system appliances 2 feet from the easterly abutter.  The converted porch will be nonconforming in that it is located 4.2 feet from the easterly abutter.   Also proposed is the construction of a deck 24 feet from the easterly abutter and the installation of an exterior mechanical system appliance (generator) 11.1 feet from the easterly abutter where a 25 foot setback is required. The building coverage will remain 2,089 square feet (6.6%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 110.18 feet of frontage where 150 feet is required and is contains 31,430 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Sections V.B. of the Protective Bylaw.  

Application No. 18-063: Jeffrey and Jayne Chandler, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 24 Windmill Lane, also shown on the Town of Chatham’s Assessors’ Map 16A Block 18 Lot H2.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling.  The existing dwelling is nonconforming in that it is located entirely within the Coastal Conservancy District (Flood Plain ele. 13), is located 35.5 feet from the road, 21.8 feet from the westerly abutter and 11.7 feet from the easterly abutter.  The proposed dwelling will be nonconforming in that it will be located within Coastal Conservancy District where a 50 foot setback is required, will be located 35.5 feet from the road where a 40 foot setback is required, 22 feet from the westerly abutter and 11.7 feet from the easterly abutter where a 25 foot setback is required.  The existing building coverage is 1,668 square feet (5.7%) and the proposed building coverage is 2,625 square feet (9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 100 feet of frontage where 150 feet is required, contains 0 square feet of buildable upland where 20,000 square feet is required and contains 29,200 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.  

Application No. 18-064: Robert and Stephanie Goley, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 66 Stage Coach Drive, also shown on the Town of Chatham’s Assessors’ Map 4F Block 8 Lot F28.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition and demolition of the existing shed.  The existing dwelling is nonconforming in that it is located 35.1 feet from the road where a 40 foot setback is required, 24.3 feet from the westerly abutter and a shed located 1 foot from the northerly abutter where a 25 foot setback is required. The addition on the southerly side is proposed to be located 8.3 feet from the abutters setback where a 25 foot setback is required, thereby creating a new nonconformity.  The existing building coverage is 1,301 square feet (12%) and the proposed lot coverage is 1,626 square feet (15%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 110 feet of frontage where 150 feet is required and contains 10,840 square feet where 60,000 square feet is required in the R60 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.  Under Application No. 18-065, the Applicant seeks a Dimensional Variance to construct the proposed addition 8.3 feet from the southerly abutter where a 25 foot setback is required.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.           

Application No. 18-066: Terry Savage and Roberta Masiello, c/o Eastward Companies, 155 Crowell Road, Chatham, MA 02633, owner of property located at 103 Aunt Nabby’s Lane, also shown on the Town of Chatham’s Assessors’ Map 10B Block 21 Lot 6.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a deck.  The existing dwelling is nonconforming in that it is located 26 feet from the Coastal Conservancy District. The proposed deck will be nonconforming in that it will be located 21 feet from the Coastal Conservancy District where a 50 foot setback is required. The building coverage will remain 1,613 square feet (16.6%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 15,100 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.   

Application No. 18-060: 782 Main Chatham LLC, c/o Benjamin Zehnder, Esq., PO Box 2300, Orleans, MA 02653, owners of property located at 784 Main Street, also shown on the Town of Chatham’s Assessors’ Map 14E Block 36 Lot 55.  The Applicant seeks to enlarge, extend, or change a nonconforming structure and use on a nonconforming lot via the demolition of the existing structure containing four (4) apartments incidental to a commercial use and the construction of a new structure containing three (3) apartments incidental to a commercial use.  Also proposed is the construction of a three car garage.  The existing mixed use structure located at 782 Main Street will remain unchanged.  The existing structure is nonconforming in that it is setback 8.9 feet from the westerly abutter and 14.7 feet from the easterly abutter. The proposed structure will be nonconforming in that it will be 12.1 feet from the westerly abutter where 15 feet is required.  The existing lot coverage is 10,971 square feet (60%) and the proposed lot coverage is 12,729 square feet (69.6%) where 70% is the maximum allowed.  The parking is and will remain nonconforming within the westerly abutters setback at 7.5 feet and within the easterly abutters setback at 5.3 feet where 10 feet is required. The lot is nonconforming in that it contains 18,282 square feet where 50,000 square feet is required for the existing uses in the GB2 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 & 9 and Sections V.B. & VIII.D.2.b. of the Protective Bylaw.  Under Application No. 18-061, the Applicant seeks a Dimensional Variance from the required 15 foot abutters setback, the floor area requirement that 51% be utilized as commercial space and the land area requirement for three (3) apartments incidental to a commercial use to allow for the construction of the of the new structures as described above.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.
