The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, April 23, 2015, starting at 3:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-015: Ellen Wright, c/o William F. Riley, Esq., 156 Crowell Road, Po Box 707, Chatham, MA  02633, and owner of the property located at 58 Oyster Pond Furlong, also shown on the Town of Chatham’s Assessors’ Map 13E Block 35 Lot 8.  The Applicant seeks to change, alter or extend a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and construction of a new dwelling.  The existing dwelling is nonconforming in that it has a road setback of 14 feet where 40 feet is required, and is 9.6 feet from the westerly abutter’s setback where 25 feet is required, and is 20 feet setback from the Conservancy District where 25 feet is required.  The proposed dwelling will be nonconforming in that the road setback will be 14 feet where 40 feet is required, and 13.1 feet from the westerly abutter’s setback where 25 feet is required, and 26 feet setback from the Conservancy District where 25 feet is required. The existing building coverage is 1,524 square feet and the proposed building coverage is 1,634 square feet where 15% is allowed, but not more than 2,800 square feet.  The lot is nonconforming in that it contains 11,170 square feet where 40,000 square feet is required and contains 100 feet of frontage where 150 feet is required.  The lot is located within the R40 zoning district.  A Special Permit is required under Section VB of the Chatham Protective Bylaw.  

Application No. 15-016: Art and Janet Bergeron, c/o Walter R. Warren, Jr., d/b/a Northside Home Improvement, 40 Alexander Drive, Yarmouth Port, MA  02675, owner of the property located at 34 Youngs Road, also shown on the Town of Chatham’s Assessors’ Map 9D Block 31C Lot X3.  The Applicant seeks to change, alter or extend a pre-existing nonconforming use via the construction of a 124 square foot addition to the northwestern corner of the existing dwelling.  The existing dwelling is one of multiple dwellings located on a lot within a zoning district which does not allow multiple dwellings.  The existing building coverage is 9.87% and the proposed building coverage will be 10% where 10% is the maximum allowed.  The lot is 96,400 square feet and located within the R20 zoning district.  A Special Permit is required under Section VIII and VB of the Chatham Protective Bylaw.  

Application No. 15-018: Nicole Bernard Dawes and Peter M. Dawes, c/o Michael D. Ford, Esq., 72 Main Street, PO Box 485, West Harwich, MA  02671, owners of the property located at 149 Cross Street, also shown on the Town of Chatham’s Assessors’ Map 14C Block 12 Lot 39.  The Applicants seek to change, alter or extend a nonconforming dwelling on a nonconforming lot via the lifting of the original portion of the existing dwelling and placing on a new foundation, demolishing and constructing the rear portion of the existing dwelling, and constructing an addition.  Also included are the demolition of both the attached and detached shed and the installation of a pool.  The existing dwelling is nonconforming in that it has a road setback of 37.9 feet where 40 feet is required and the easterly abutter’s setback is 10.7 feet where 25 feet is required.  The proposed dwelling will conform as to road setback, but will maintain the easterly abutter’s setback of 10.7 feet where 25 feet is required.   The existing building coverage is 1,145 square feet (7.03%) and the proposed building coverage is 2,229 square feet (13.68%) where 15% is allowed.  The lot is nonconforming in that the lot contains 16,269 square feet where 40,000 square feet is required and the lot frontage is 65.14 feet where 150 feet is required.  The lot is located within the R40 zoning district.  A Special Permit is required under Section VB of the Chatham Protective Bylaw.  

Application No. 15-014: Kevin H. and Rita A. Marino, c/o Michael D. Ford, 72 Main Street, Post Office Box 485, West Harwich, MA  02671, owner of the property located at 149 Seapine Road, also shown on the Town of Chatham’s Assessors’ Map 11K Block 34 Lot HC12.  The Applicant seeks to change, alter or extend a pre-existing nonconforming dwelling with attached garage, to allow the Applicant to demolish the existing nonconforming dwelling and construct a new dwelling with attached garage on a nonconforming lot.  The existing dwelling is nonconforming in that it is 39 feet setback from the Conservancy District where 50 feet is required.  The proposed dwelling will be setback 68 feet from the Conservancy District, thereby conforming to the 50 foot setback requirement.  The existing building coverage is 2,318 square feet (7.6%) and the proposed building coverage will be 2,867 square feet (9.4%) where 10% is maximum allowed.  The lot is nonconforming in that it contains 36,230 square feet where 40,000 square feet is required.  The lot is located within the R40 zoning district.  A Special Permit is required under Section VB of the Chatham Protective Bylaw.  CONTINUED FROM APRIL 9, 2015.
