LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, April 24, 2014, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following appeals:

Appeal No. 14-011: On Shore at Last, LLC, 104 Crowell Road, Chatham, MA  02633, c/o Michael D. Ford, PO Box 485, West Harwich, MA  02671, owner of property located at 157 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16D, Block 33, Lot 40. The appellant proposes to change, alter, or expand a nonconforming structure with attached garage by demolishing the existing structure and reconstructing a single family dwelling, detached garage with a one bedroom guestroom, and pool.  The existing structure is nonconforming in that the northern abutter’s setback is 16.8 feet and the southern abutter’s setback is 21.5 feet where 25 feet is required.  The lot is nonconforming in that it has 136.3 feet frontage where 150 feet is required.  The Appellant seeks to raze and rebuild a new five bedroom dwelling which will have a foot print of 4,391 square feet, and proposed garage with one bedroom which will have a footprint of 1,080 square feet, and will result in total building coverage of 5,471 square feet or 9.7% where 10% is allowed.  The proposed structure will conform to setback requirements.  The property is within the R-40 Zoning District.  A Special Permit is required under Section V.B., Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw. Continued from March 27, 2014.

Appeal No. 14-021: Mark Haddad Trustee, JKJ Shore Road Nominee Trust, 77 Clifton Road, Milton, MA  02186, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of property located at 27 Shore Road, also shown on the Town of Chatham’s Assessors’ Map 16D, Block 25, Lot F3. The appellant proposes to relocate and expand the existing dwelling on the lot in order to meet all setback requirements, and construct an addition of 1,476 square feet with an attached garage.  The existing building coverage is 921 square feet (3.5%) and the proposed building coverage will be 2,143 square feet (8.2%).  The lot is nonconforming as it has 107.8 feet of frontage where 150 feet is required, and has 33,405 square feet where 40,000 square feet is required.  The dwelling is nonconforming as it is 40 feet from the Inland Conservancy District where 50 feet is required.  The proposed foundation is 3 feet higher than the existing foundation elevation.  The Zoning District is R-40.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-022: Howard and Lisa Van Vleck, 11 Shady Hill Square, Cambridge, MA  02138, c/o Michael Ford, Esq., 78 Main Street, PO Box 485, West Harwich, MA  02671, owner of property located at 594 Old Harbor Road, Chatham, MA, 02650, also shown on the Town of Chatham’s Assessors’ Map 16H, Block 10A, Lot 7A.  The appellants request a modification of Special Permit #13-055 to relocate the nonconforming boathouse 10 feet seaward and reduce the height of the proposed boathouse ridge line by 2 feet from elevation 25 feet 6 inches to elevation 23 feet 6 inches. Also, Appellant requests the 5th paragraph of the Decision be changed from “dwelling” to “boathouse”.  On October 28, 2013, the Appellant was granted a Special Permit #13-055 to alter and relocate a nonconforming boathouse in Coastal Conservancy District 8.2 feet from the northeasterly abutter’s lot line where a 25 foot setback is required.  The permit was granted based on the existing boathouse being nonconforming in that it is located 1.6 feet from the northeasterly abutter’s lot line where 25 feet is required.   Special Permit #13-055 was appealed and these changes reflect a settlement reached between two parties.  The total lot area is 54,149 square feet and the Zoning District is R40.  A Special Permit is required under Section V.B., Non-Conforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective By-Law and M.G.L. Chapter 40A, Section 14.  

Appeal No. 14-023: Timothy S. and Deborah B. Charlebois, 89 High Point Road, Andover, MA  01810, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650,  the owners of property located at 9 Chatharbor Lane, also shown on the Town of Chatham’s Assessors’ Map 5B, Block 21A, Lot 9A. The appellants propose to change, alter, or extend a nonconforming single family dwelling on a nonconforming lot via the construction of an 486 square foot addition 10.2 feet from the road where 25 feet is required and 33.3 feet from the Coastal Conservancy District where 50 feet is required.  The proposed dwelling foundation will be raised 1.7 feet.  The existing structure is nonconforming in that it is located 9.2 feet from the road where 25 feet is required and 21 feet from the Coastal Conservancy District where 50 feet is required.  The lot is nonconforming in that it contains 17,600 square feet of buildable upland where 20,000 square feet is required.  The property is located in an R-20 Zoning District.  A Special Permit is required under Section V.B. Nonconforming Lots, Buildings and Uses, Enlargement, Extension or Change of the Protective Bylaw.

Appeal No. 14-024:  Nickerson Corners Condo Association, c/o Ward Brown, 210-216 Orleans Road, owner of property located at 210-216 Orleans Road, also shown on Assessors Map 14H, Block 64, Lot R16.  The Appellant is requesting the grant of a Permit by the Sign Code Appeals Committee to install a 66 inch (5 foot 5 inch) by 72 inch (6 foot) ground sign for a total of 33 square feet.  The proposed ladder sign will be 8.16 feet high and located 20 feet from Orleans Road.  Section 225-24 C. Regulations for Small Business Zones of the Chatham Sign Code, allows a maximum of 8 square feet and a maximum of 6 feet in height.  The property contains 31,761 square feet, consists of commercial condominiums, and located within the SB and R40 Zoning Districts but the ladder sign is specifically located within the SB Zoning District. A Permit is required under Section 225-19, Appeal Permits, of the Chatham Sign Code.    

Appeal No. 14-025:  Nickerson Corners MJM, LLC, c/o Michael J. Mullaney, 375 Great Western Road, owner of property located at 210 Orleans Road, also shown on Assessors Map 14H, Block 64, Lot R16.  The Appellant is requesting the grant of a Permit by the Sign Code Appeals Committee to install a 21.5 inch (1 foot 8 inch) by 120 inch (18 foot) wall sign for a total of 18 square feet.  Section 225-24 C. Regulations for Small Business Zones of the Chatham Sign Code, allows a maximum of 1 square foot.  The property contains 31,761 square feet, consists of commercial condominiums, and is located within the SB and R40 Zoning Districts but the wall sign is specifically located within the SB Zoning District. A Permit is required under Section 225-19, Appeal Permits, of the Chatham Sign Code.
