LEGAL NOTICE

The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, April 9, 2015, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 15-010: Golden Years Pleasant Street, LLC., c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owner of the property located at 121 Queen Anne Road, also shown on the Town of Chatham’s Assessors’ Map 14E Block 12 Lot 5.  The Applicant seeks a Special Permit to demolish the existing nonconforming dwelling and construct a new dwelling on a nonconforming lot.  The existing dwelling is nonconforming in that its westerly abutter’s setback is 14.2 feet and its easterly abutter’s setback is 18.6 feet where 25 feet is required.  The proposed dwelling will have an easterly abutter’s setback of 20 feet and the westerly abutter’s setback of 27.3 feet where 25 feet is required.  The existing dwelling has a building coverage of 2,290 square feet (11.1%) and the proposed building coverage is 2,830 square feet (13.7%) where 2,850 square feet is the maximum allowed.  The lot is nonconforming in that it contains 20,715 square feet where 40,000 square feet is required, has 123.84 feet of frontage where 150 feet is required.  The lot is located within the R40 zoning district.  A Special Permit is required under Section VIII of the Chatham Protective Bylaw.  Also proposed is a walkway with at-grade steps within the Coastal Conservancy District which requires a Special Permit under Section IV of the Protective Bylaw.   

Application No. 15-012: Thomas S. and Jennifer L. Smith, c/o T. Stephen Smith, PO Box 616, South Chatham, MA  02659, owners of the property located at 123 Cedar Street, also shown on the Town of Chatham’s Assessors’ Map 13C Block 4 Lot 16.  The Applicant seeks to amend Special Permit No. 06-088 to remove the deed restriction of 3 bedrooms.  The lot is nonconforming in that it contains 36,964 square feet where 40,000 square feet is required.  The lot is located within the R40 zoning district.  A Special Permit is required under Section VIII of the Chatham Protective Bylaw.  

Application No. 15-013: Town of Chatham, c/o Ted Keon, Coastal Resources Department, 261 George Ryder Road, Chatham, MA  02633, owners of the property located at 90 Bridge Street, also shown on the Town of Chatham’s Assessors’ Map 14A Block 2 Lot 11.  The Applicant seeks to reconstruct an existing pier in poor condition.  The existing pier is a “T” shape with a 10 foot wide access platform leading to a 30 foot wide T-head pier.  The proposed pier will be almost the identical layout and will consist of eight timber piles supporting a timber framed deck structure.     The lot is approximately 4,200 square feet, located within the R40 Zoning District and located wholly within the Coastal Conservancy District.  A Special Permit is required under Section IV of the Chatham Protective Bylaw.  

Application No. 15-014: Kevin H. and Rita A. Marino, c/o Michael D. Ford, 72 Main Street, Post Office Box 485, West Harwich, MA  02671, owner of the property located at 149 Seapine Road, also shown on the Town of Chatham’s Assessors’ Map 11K Block 34 Lot HC12.  The Applicant seeks to change, alter or extend a pre-existing nonconforming dwelling with attached garage, to allow the Applicant to demolish the existing nonconforming dwelling and construct a new dwelling with attached garage on a nonconforming lot.  The existing dwelling is nonconforming in that it is 39 feet setback from the Conservancy District where 50 feet is required.  The proposed dwelling will be setback 68 feet from the Conservancy District, thereby conforming to the 50 foot setback requirement.  The existing building coverage is 2,318 square feet (7.6%) and the proposed building coverage will be 2,867 square feet (9.4%) where 10% is maximum allowed.  The lot is nonconforming in that it contains 36,230 square feet where 40,000 square feet is required.  The lot is located within the R40 zoning district.  A Special Permit is required under Section VB of the Chatham Protective Bylaw.
