The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, December 1, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-075: Charna and Scott Daly, c/o Andrew Singer, Esq., Po Box 67, Dennisport, MA  02639, owner of the property located at 378 Cockle Cove Road, also shown on the Town of Chatham’s Assessors’ Map 5B Block 19 Lot 13.  The Applicants seek to demolish the existing dwelling and shed and construct a new dwelling, 9.3 feet from the northerly abutters setback.  The lot on which the house is located was created pursuant to the provisions of M.G.L. Chapter 41, Section 81L.  The existing dwelling has a northerly abutters setback of 8.9 feet where 15 feet is required.  The existing building coverage is 1,084 square feet (10.1%) and the proposed building coverage is 1,196 square feet (11.1%) where 15% is the maximum allowed.  The lot contains 10,884 square feet where 20,000 square feet is required in the R20 Zoning District.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw from Section III.D.  Continued from October 13, 2016 and re-advertising to incorporate an amended request for a Special Permit, in the alternative, under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw. 

Application No. 16-088: Laurie and Robert Fitzpatrick, 9 Pellet Lane, South Chatham, MA  02659, owners of property located at 9 Pellet Lane, also shown on the Town of Chatham’s Assessors’ Map 2A Block 51 Lot 50. The Applicant proposes to complete the construction of an addition as approved under Special Permit No. 02-12.  The existing dwelling is nonconforming in that it is setback 15 feet from the road where 25 feet is required; and is located 8.9 feet from the easterly abutter where 15 feet is required.  The proposed addition will be placed on the existing foundation which is setback 10.7 feet from the road where 25 feet is required.  The existing building coverage is 18.6% and the proposed building coverage is 22% where 15% is the maximum allowed.  The lot is nonconforming in that it contains 6,069 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. of the Protective Bylaw.  Continued from November 17, 2016 for re-advertising.      

Application No. 16-090: Laurie and Vincent Sansone, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA  02650, owners of property located at 7 Bucks Lane, also shown on the Town of Chatham’s Assessors’ Map 8A Block 5 Lot S1. The Applicant proposes to change, alter, or expand a nonconforming structure on a nonconforming lot via the construction of a sunroom and a second floor deck over a portion of an existing deck.  The existing dwelling (deck) is nonconforming in that it is located 22.6 feet from the road where 25 feet is required and is located within the setback to the Coastal Conservancy District where a 50 foot setback is required.  The existing building coverage is 1,104 square feet (17.3%) and the proposed building coverage is 1,240 square feet (19.4%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 11,740 square feet and 6,392 square feet of buildable upland where 20,000 square feet is required in an R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section VB of the Chatham Protective Bylaw.
