The Chatham Zoning Board of Appeals will hold a public hearing on Thursday, November 3, 2016, starting at 4:00 PM in the Town Annex Large Meeting Room, 261 George Ryder Road, on the following applications:

Application No. 16-079: Eastward Homes Business Trust, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at Lot 16 Hydrangea Lane, also shown on the Town of Chatham’s Assessors’ Map 13F, Block 29, Lot H14. The Applicant proposes to construct a single family dwelling in a GB3 zone which requires the grant of a Special Permit.  The proposed dwelling will comply with all bulk and dimensional requirements of the bylaw.  The lot is conforming 15,780 square feet where 10,000 square feet is required in a GB3 Zoning District.  A Special Permit is required under Section III.C.4.c.26 of the Chatham Protective Bylaw.  Continued from October 27, 2016.

Application No. 16-080: Eastward Homes Business Trust, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at Lot 17 Hydrangea Lane, also shown on the Town of Chatham’s Assessors’ Map 13F, Block 29, Lot H17. The Applicant proposes to construct a single family dwelling in a GB3 zone which requires the grant of a Special Permit.  The proposed dwelling will comply with all bulk and dimensional requirements of the bylaw.  The lot is conforming 16,519 square feet where 10,000 square feet is required in a GB3 Zoning District.  A Special Permit is required under Section III.C.4.c.26 of the Chatham Protective Bylaw.  Continued from October 27, 2016.

Application No. 16-081: Eastward Homes Business Trust, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at Lot 18 Hydrangea Lane, also shown on the Town of Chatham’s Assessors’ Map 13F, Block 29, Lot H18. The Applicant proposes to construct a single family dwelling in a GB3 zone which requires the grant of a Special Permit.  The proposed dwelling will comply with all bulk and dimensional requirements of the bylaw.  The lot is conforming 17,712 square feet where 10,000 square feet is required in a GB3 Zoning District.  A Special Permit is required under Section III.C.4.c.26 of the Chatham Protective Bylaw.  Continued from October 27, 2016.

Application No. 16-083: John and Tanya Lund, c/o William F. Riley, Esq., PO Box 707, Chatham, MA  02633, owners of property located at 181 Champlain Road, also shown on the Town of Chatham’s Assessors’ Map 12A, Block 8, Lot 7A. The Applicant proposes to modify Special Permit No. 16-042, granted on July 14, 2016.  The Applicant seeks to modify Special Permit No. 16-042 to allow for a relocation of the proposed dwelling, modification of design to allow for the construction of a dormer and the demolition of the existing garage and construction of a new garage with conditioned space above.  The existing dwelling is setback 11 feet from the road and the existing garage is setback 24.9 feet from the road where 40 feet is required. The proposed dwelling will be setback 14.1 feet from the road and the proposed garage will be setback 14.6 feet from the road where 40 feet is required.  The existing dwelling is 15.3 feet from the westerly abutters setback and the proposed dwelling will be setback 15.2 feet where 25 feet is required.  The existing and proposed garage will be 10.9 feet from the westerly abutters setback where 25 feet is required.  Also proposed is the installation of Exterior Mechanical System Appliance (Air Conditioning Units) 10 feet from the westerly abutters setback where 25 feet is required.  The lot is nonconforming in that it contains 26,136 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A, Section 6, and Section V.B. and Section III.D.3.g of the Protective Bylaw.   

Application No. 16-084: Thomas and Debra Cody, c/o John Domos, 14 Second Street, Harwich, MA  02645, owner of property located at 219 Joshua Jethro Road, also shown on the Town of Chatham’s Assessors’ Map 7I Block 8 Lot C249.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the construction of an addition.  The proposed addition will meet all bulk and dimensional requirements of the bylaw, but is considered an intensification on a nonconforming lot which requires the grant of a Special Permit.  The existing building coverage is 1,840 square feet (8.6%) and the proposed building coverage is 1,948 square feet (9.1%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 21,352 square feet where 60,000 square feet is required in the R60 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.   

Application No. 16-085: Robert and Ann Joyal, c/o J. Thaddeus Eldredge, 1038 Main Street, Chatham, MA 02633, owner of property located at 33 Patuxet Trail, also shown on the Town of Chatham’s Assessors’ Map 5D Block 74 Lot M17.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the construction of additions.  The proposed additions will meet all bulk and dimensional requirements of the bylaw, but is considered an intensification on a nonconforming lot which requires the grant of a Special Permit.  Also proposed is the construction of a bulkhead, less than 30 square feet, 10.2 feet from the westerly abutter, in accordance with Section III.D.3.f. and the construction of a 96 square foot shed, 5.5 feet from the northerly and westerly abutters setbacks, in accordance with Section III.D.3.h.2.  The existing building coverage is 646 square feet (6.6%) and the proposed building coverage is 1,189 square feet (12.2%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 13,385 square feet and 9,759 square feet of buildable upland where 20,000 square feet is required and has 79.57 feet of frontage where 100 feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.
