Application No. 23-094: The Casey 2014 Funding Trust, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owner of property located at 444 Cockle Cove Road, also shown on the Town of Chatham’s Assessors’ Map 5B Block 12 Lot 20.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in it is located 5.9 feet from the northeasterly abutter, 11.4 feet from the easterly abutter, and within the Coastal Conservancy District.  The proposed dwelling will be nonconforming in that it will be located 6 feet from the northeasterly abutter, 6.5 feet from the easterly abutter and within the Coastal Conservancy District where a 50 foot setback is required.  The existing building coverage is 1,155 square feet (39.6%) and the proposed building coverage is 1,170 square feet (40%) where 15% but not more than 2,800 square feet is the maximum allowed.  The lot is nonconforming in that it contains 2,920 square feet of buildable upland and contains 7,340 square feet of land area where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.  Continued from November 2, 2023 and December 7, 2023.  

Application No. 23-113: James Fox, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owner of property located at 90 Seaview Street, also shown on the Town of Chatham’s Assessors’ Map 15E Block 72 Lot 5.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the installation of a new foundation, relocation of the dwelling and construction of an addition.  Also proposed is the replacement and installation of exterior mechanical system appliances.  The existing dwelling is nonconforming in that it is located 4 feet from the easterly abutter.  The generator is and will remain nonconforming in that it is located 3.8 feet from the easterly abutter.  The existing A/C condenser is nonconforming in that it is located 13.6 feet from the southerly abutter.  The proposed dwelling will be nonconforming in that it will be located 5.9 feet from the easterly abutter where a 15 foot setback is required.  The proposed mechanical systems will be nonconforming in that they will be located 12 feet from the southerly abutter where a 15 foot setback is required. The existing building coverage is 1,668 square feet (16.8%) and the proposed building coverage is 1,966 square feet (19.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 9,948 square feet where 20,000 square feet square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.
Application No. 23-114: B & N Real Estate Trust, c/o William G. Litchfield, Esq., 330 North Chatham, Chatham, MA 02650, owner of property located at 668 Orleans Road, also shown on the Town of Chatham’s Assessors’ Map 15I Block 9 Lot 18.  The Applicant seeks to enlarge, extend, or change a nonconforming guest house on a nonconforming lot via the demolition of the existing guest house and the construction of a new guest house.  The existing guest house is nonconforming in that it is located 15.6 feet from the easterly abutter and exceeds 50% of the floor area allowed for a guest house by 559 square feet or 28.8%.  The proposed guest house will be nonconforming in that it will be located 20 feet from the easterly abutter where a 25 foot setback is required and will exceed the allowable 50% of the floor area by 2,603 square feet or 134%.  The existing building coverage is 2,903 square feet and the proposed building coverage is 2,888 square feet where 2,850 square feet is the maximum allowed.  The lot is nonconforming in that it contains 25,667 square feet where 40,000 square feet square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.

Application No. 23-115: Kimberly and Richard Williams, c/o Theodore Streibert, 15 Linden Tree Lane, Chatham, MA 02633, owners of property located at 30 Ocean View Terrace, also shown on the Town of Chatham’s Assessors’ Map 15F Block 58 Lot 82.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition and the replacement of the existing roof structure.  The existing dwelling is nonconforming in that it is located 10.1 feet from the easterly abutter.  The proposed addition will be nonconforming in that it will be located 10.5 feet from the easterly abutter where a 15 foot setback is required.  The existing building coverage is 936 square feet (9.8%) and the proposed building coverage is 1,328 square feet (13.9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 60 feet of frontage where 100 feet is required and contains 9,555 square feet of land area where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 23-117: C & K Chipping Stone LLC, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 90 Chipping Stone Road, also shown on the Town of Chatham’s Assessors’ Map 7H Block 19 Lot C370. The Applicant seeks to modify Special Permit No. 22-103 granted on November 17, 2022, which allowed for the construction of a second floor and addition as well as the reconstruction and expansion of a conforming deck.  The Applicant now seeks to modify this Special Permit to allow for the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 30.6 feet from the road and 10.4 Feet from the northerly abutter.  The proposed dwelling will be nonconforming in that it will be located 30.6 feet from the road where a 40 foot setback is required and 10.4 feet from the northerly abutter where a 25 foot setback is required.  The existing building coverage is 2,599 square feet and the proposed building coverage is 2,881 square feet where 2,950 square feet is the maximum allowed.  The lot is nonconforming in that it contains 28,108 square feet where 60,000 square feet is required in the R60 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Protective Bylaw.
