Approval of Minutes –November 3, 2022

Application No. 22-107: Sandy Bliss LLC, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owner of property located at 75 Main Street, also shown on the Town of Chatham’s Assessors’ Map 16B Block 64B Lot 68X2.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the partial demolition of the existing dwelling, installation of a new foundation and the construction of additions.  The proposed dwelling will comply with road and abutter setback requirements.  The dwellings located at 71 & 77 Main Street will remain unchanged.  The existing building coverage is 3,767 square feet and the proposed building coverage is 3,682 square feet where 2,950 square feet is the maximum allowed.  The lot is nonconforming in that it contains three dwelling units where one would be allowed and contains 0 feet of frontage where 100 feet is required.  The lot contains 26,266 square feet in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Sections V.B. of the Chatham Protective Bylaw.  The Applicant has requested a continuance to January 26, 2023.

Application No. 22-108: Chatham Productions LLC, c/o Greg Clark, 1234 Chestnut Street, Suite 211, Newton, MA 02464, owner of property located at 5 Annabelle Lane, also shown on the Town of Chatham’s Assessors’ Map 14E Block 37 Lot 5. The Applicant proposes to construct a single family dwelling in a GB2 zone which requires the grant of a Special Permit.  The proposed lot coverage is 4,013 square feet (31.2%) where 70% is the maximum allowed.  The lot is conforming with 12,877 square feet where 7,000 square feet is required in a GB2 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 9 and Sections III.C.4.c.26 and VIII.D.2.b. of the Protective Bylaw.  The Applicant has requested a withdrawal without prejudice.

Application No. 22-100: CBI 20 45 Chatham Bars Avenue LLC, c/o Andrew L. Singer, Esq., PO Box 67, Dennis Port, MA  02639, owners of property located at 20 Chatham Bars Avenue, also shown on the Town of Chatham’s Assessors’ Map 15D Block 47 Lot 95.  The Applicant seeks a Special Permit under Section III.D.3.i. to allow a use permitted in the less restrictive zone to be authorized for the entire lot.  If the commercial use of the lot is allowed, a Special Permit under Section III.C.4.c.10. is required for a ten (10) bed dormitory and professional office.  The existing structure is and will remain nonconforming in that it is setback 12.7 feet from the private way where 25 feet is required.  The parking areas are nonconforming in that they are located 5 feet from the southerly abutter, 10 feet from the easterly abutter and 7 feet from the private way.  The existing lot coverage is 9,239 square feet (52.7%) and the proposed lot coverage is 10,104 square feet (57.7%) where 70% is the maximum allowed.  The lot contains 17,523 square feet in the R20/GB2 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 & 9 and Sections III.C.4.c.10, III.D.3.i., V.B., VII.B.11. & VIII.D.2.b. of the Protective Bylaw.

Application No. 22-106: Thomas J. and Joanne M. Regan, c/o Chris Childs, 537 Route 28, Harwich Port, MA 02646, owner of property located at 65 Pine Ridge Road, also shown on the Town of Chatham’s Assessors’ Map 8B Block 73 Lot S18. The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The proposed dwelling will comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The existing building coverage is 954 square feet (7.6%) and the proposed building coverage is 1,508 square feet (12%) where 15% square feet is the maximum allowed.  The lot is nonconforming in that it contains 12,531 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw. 


Application No. 22-110: Roland and Deborah Trailor, c/o Erik Tolley, 299 White’s Path, South Yarmouth MA 02664, owners of property located at 166 Landing Lane, also shown on the Town of Chatham’s Assessors’ Map 13K Block 30 Lot R11.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing deck and the construction of an open porch.  The existing deck is nonconforming in that it is located 17.8 feet from the easterly abutter.  The proposed open porch will be nonconforming it that it will be located 17.8 feet from the easterly abutter where a 25 foot setback is required.  The existing building coverage is 2,137 square feet and the proposed building coverage is 2,717 square feet where 2,850 square feet is the maximum allowed.  The lot is nonconforming in that it contains 21,007 square feet in a R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 22-114: Highland Realty Trust, c/o Mike Tartamella, 160 Commonwealth Avenue, Suite L3, Boston MA 02116, owners of property located at 309 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 14C Block 47 Lot 31.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the installation of a new foundation and the construction of additions. The existing dwelling is nonconforming in that it is located 22 feet from the road where a 40 foot setback is required, 17.4 feet from the northerly abutter and 14 feet from the southerly abutter where a 25 foot setback is required.  The existing barn will remain nonconforming as to the southerly abutters setback of 2.6 feet.  The proposed addition will be nonconforming it that it will be located 18 feet from the northerly abutter.  The proposed bay window will be nonconforming in that it will be located 16 feet from the southerly abutter.  The building height of the dwelling will increase within the required road and abutters setback requirements.  The building coverage will remain 2,291 square feet (7.2%) where 10% is the maximum allowed.  The lot is nonconforming in that it contains 69 feet of frontage where 150 feet is required and contains 31,679 square feet where 40,000 square feet is required in a R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and Section V.B. of the Chatham Protective Bylaw.
