Approval of Minutes – March 9, 2023

Application No. 23-016: John C. and Tracy Cannon, c/o Chris Cannon, PO Box 201, Chatham, MA 02633, owners of property located at 33 Cockle Cove Road, also shown on the Town of Chatham’s Assessors’ Map 5E Block 10 Lot 5.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the partial demolition of the existing dwelling and the construction of an addition and the installation of exterior insulation.  The existing dwelling is nonconforming in that it is located 14.5 feet from the northerly abutter.  The proposed dwelling will be nonconforming in that it will be located 14 feet from the northerly abutter where a 15 foot setback is required.  The existing building coverage is 1,059 square feet (12.7%) and the proposed building coverage is 1,167 square feet (14%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 0 feet of frontage where 100 feet is required and contains 8,333 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. 

Application No. 23-018: Brion and Elizabeth Strapp, c/o William F. Riley, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 158 Old Queen Anne Road, also shown on the Town of Chatham’s Assessors’ Map 12G Block 8 Lot 1A.  The Applicant seeks a Dimensional Variance from the required road setback under Appendix II of the Protective Bylaw for the installation of terraced retaining walls.  The proposed walls will be located 2.5 feet from the road where a 25 foot setback is required.  The lot contains 20,129 square feet in the R20 Zoning District.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.  

Application No. 23-024: Mariah G. Kelly, c/o William F. Riley, Esq, PO Box 707, Chatham, MA 02633, owner of property located at 57 Hitching Post Road, also shown on the Town of Chatham’s Assessors’ Map 14F Block 1 Lot 2.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the partial demolition of the existing dwelling and deck and the construction of an addition and deck. The existing dwelling is nonconforming in that it is located 14.7 feet from the southerly abutter, and the existing deck is nonconforming in that it is located 4.7 feet from the southerly abutter.  The proposed addition will be nonconforming in that it is located 14.1 feet from the southerly abutter, and the proposed deck will be nonconforming in that it will be located 4.3 feet from the southerly abutter where a 15 foot setback is required.  The existing building coverage is 1,260 square feet (13.3%) and the proposed building coverage is 1,382 square feet (14.6%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 9,497 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. 

Application No. 23-027: 184 Barcliff LLC, c/o James M. Norcross, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 184 Barcliff Avenue, also shown on the Town of Chatham’s Assessors’ Map 15G Block 20 Lot V1.  The Applicant seeks to enlarge, extend, or change nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling  and detached garage and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 21.3 feet from the road.  The existing garage is nonconforming in that it is located 4.1 feet from the westerly abutter and 16.2 feet from the northerly abutter where a 25 foot setback is required.  The proposed dwelling will be nonconforming in that it will be located 22 feet from the road where a 40 foot setback is required.  The building coverage will remain nonconforming at 1,503 square feet (15.2%) where 15% is the maximum allowed.  The lot is nonconforming in that it 9,917 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.     

Application No. 22-109: Jeffrey and Anne Elton, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owner of property located at 66 Billings Road, also shown on the Town of Chatham’s Assessors’ Map 7A Block 12 Lot S48.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling. The existing dwelling is nonconforming in that it is located 14.8 feet from the easterly abutter where a 15 foot setback is required and 30.9 the Coastal Conservancy District (Floodplain ele. 15).  The proposed dwelling will be nonconforming in that it will be located 29 feet from the Coastal Conservancy District where a 50 foot setback is required.  The existing building coverage is 2,640 square feet (21.1%) and the proposed building coverage is 2,619 square feet (21%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 12,500 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Sections V.B. of the Chatham Protective Bylaw.  Continued from March 9, 2023, for re-advertising.
