The Applicant a Special Permit to construct a public utility facility (wastewater pump station), as allowed by Special Permit under Section III.C.1.c.7. of the Bylaw. A Special Permit is required under M.G.L. Chapter 40A Section 9 and Section VIII.D.2.b. of the Protective Bylaw. Application No. 22-109: Jeffrey and Anne Elton, c/o Michael D. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling. The existing dwelling is nonconforming in that it is located 14.8 feet from the easterly abutter where a 15 foot setback is required and 30.9 the Coastal Conservancy District (Floodplain ele. 15). The proposed dwelling will be nonconforming in that it will be located 33 feet from the Coastal Conservancy District where a 50 foot setback is required. The building coverage will remain 2,640 square feet (21.1%) where 15% is the maximum allowed. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a partial second floor addition. The existing dwelling is nonconforming in that it is located 20.8 feet from the northerly abutter and 10.6 feet from the southerly abutter. The proposed second floor addition will be nonconforming it that it will be located 20.8 feet from the northerly abutter where a 25 foot setback is required. The building coverage will remain 2,117 square feet (16.13%) where 15% is the maximum allowed. The lot is nonconforming in that it contains 13,127 square feet where 40,000 square feet is required in a R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Sections 6 and Section V.B. of the Chatham Protective Bylaw. Application No. 23-007: Christopher and Susan Jacquot, c/o Theodore Streibert, 15 Linden Tree Lane, Chatham, MA 02633, owner of property located at 27 Clam Shell Drive, also shown on the Town of Chatham’s Assessors’ Map 16A Block 30 Lot H77. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling leaving the existing foundation and first floor deck and the construction of a new dwelling. The existing dwelling is nonconforming in it is located 8.5 feet from the road, 10.6 feet from the northwesterly abutter, 15.3 feet from the southwesterly abutter, 2 feet from the southerly abutter and entirely within the Coastal Conservancy District (Flood Plain ele. 13). The proposed dwelling will be nonconforming in that it will be located 7.6 feet from the road where 40 foot setback is required, 12.7 feet from the northwesterly abutter, 14.6 feet from the southwesterly abutter, 1.7 feet from the southerly abutter where a 25 foot setback is required and entirely within the Coastal Conservancy District where a 50 foot setback is required. Also proposed is the installation of a driveway as allowed by Special Permit under section IV.A.3.d. of the Protective Bylaw. The existing building coverage is 815 square feet and the proposed building coverage is 845 square feet where 2,800 square feet is the maximum allowed. The lot is nonconforming in that it contains 0 square feet of buildable upland where 20,000 square feet is required and contains 4,823 square feet of land area where 40,000 square feet is required in the R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Protective Bylaw. Application No. 23-008: Pacifico P. and Marlluruth M. Degugliemo, c/o David Riquinha, 1A Marion Drive, Unit 5, Carver, MA 02330, owners of property located at 20 Skippers Way, also shown on the Town of Chatham’s Assessors’ Map 1A Block 14 Lot S30. The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling. The existing dwelling is nonconforming in that it is located 21.5 feet from the road and 8.2 feet from the southerly abutter. The proposed dwelling will be nonconforming in that it will be located 21.5 feet from the road where a 25 foot setback is required and 9.8 feet from the southerly abutter where a 15 foot setback is required. The existing building coverage is 1,957 square feet (18.2%) and the proposed building coverage is 2,190 square feet (20.4%) where 15% is the maximum allowed. The lot is nonconforming in that it contains 10,752 square feet where 20,000 square feet is required in the R20 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. Application No. 23-009: Eastward MBT, LLC, c/o William F. Riley, Esq., PO Box 707, Chatham, MA, 02633, owner of property located at 155 & 157 Bridge Street, also shown on the Town of Chatham’s Assessors’ Map 15B Block 1B Lot 1B. The Applicant seeks to extend Special Permit No. 20-084 for 12 months. The current expiration date is May 6, 2023, and the proposed expiration date is May 6, 2024. This Special Permit allowed the Applicant to demolish the two existing dwellings and construct two new dwellings. The lot contains 3.13 acres and 71,160 square feet of buildable upland in the R40 Zoning District. A Special Permit is required under M.G.L. Chapter 40A Sections 6 & 14 and Sections V.B. & VIII.D.2.b. of the Protective Bylaw.
