Application No. 23-099: 45 Meadow View LLC, c/o James M. Norcross, Esq., PO Box 707, Chatham, MA 02633, owners of property located at 45 Meadow View Road South, also shown on the Town of Chatham’s Assessors’ Map 10D Block 21 Lot S9.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling. The proposed dwelling will comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The existing building coverage is 1,434 square feet (8.5%) and the proposed building coverage is 2,478 square feet (14.7%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 16,817 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.  Continued from November 30, 2023.

Application No. 23-127: The James A. Doyle Revocable Trust of 2022, c/o Theodore Streibert, 15 Linden Tree Lane, Chatham, MA 02633, owner of property located at 135 Lime Hill Road, also shown on the Town of Chatham’s Assessors’ Map 12E Block 18 Lot B1.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction additions.  The existing dwelling is nonconforming in that it is located 16.7 from the southerly abutter.  The proposed addition will be nonconforming in that it will be located 16.2 feet from the southerly abutter where a 25 foot setback is required.  The existing building coverage is 1,115 square feet (7.9%) and the proposed building coverage is 1,659 square feet (11.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 14,007 square feet where 40,000 square feet square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 23-129: David and Sheila Hepp c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 22 Hilltop Lane, also shown on the Town of Chatham’s Assessors’ Map 9B Block 29 Lot 17.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a conforming lot via the construction of additions, decks and a garage with habitable space above.  The existing dwelling is nonconforming in that the uppermost level exceeds 50% of the floor below by 80 square feet and the existing building height is 32.1 feet where 30 feet is the maximum allowed.  The proposed uppermost level will be nonconforming in that it will exceed the allowable 50% by 207 square feet.  No change is proposed to the building height.  Also proposed is the construction of conforming additions and a garage with habitable space.  The existing building coverage is 2,342 square feet and the proposed building coverage is 2,989 square feet where 3,000 square feet is the maximum allowed.  The lot contains 28,210 square feet in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 23-130: Matthew J. Gavin and Alison S. Gavin, c/o Ken Murphy, PO Box 43, West Chatham, MA 02669, owners of property located at 80 Old Mail Road, also shown on the Town of Chatham’s Assessors’ Map 14I Block 27 Lot AC7.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition and deck. The existing dwelling is nonconforming in that it is located 19.39 feet from the road and 19.54 feet from the westerly abutter.  The proposed deck will be nonconforming in that it will be located 30.04 feet from the road where a 40 foot setback is required.  The existing building coverage is 889 square feet (8.89%) and the proposed building coverage is 1,209 square feet (12.09%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,000 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. 

Application No. 24-005: Joseph J. Giangregorio, Jr. Living Trust, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owner of property located at 22 Great Hill Road, also shown on the Town of Chatham’s Assessors’ Map 13G Block 53 Lot C2.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition.  The existing dwelling is nonconforming in that it is located 39.9 feet from Great Hill Road where a 40 foot setback is required, 17.52 feet from the westerly abutter and 24.1 feet from the easterly abutter where a 25 foot setback is required.  The proposed addition will conform to road and abutter setback requirements.  The existing building coverage is 1,691 square feet (15.4%) and the proposed building coverage is 1,698 square feet (15.4%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 11,000 square feet where 40,000 square feet square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.
