Application No. 23-065: William J. McEntee Jr. and April McEntee, c/o Michael D. Ford, Esq., PO Box 485, West Harwich, MA 02671, owners of property located at 47 Holway Street, also shown on the Town of Chatham’s Assessors’ Map 17C Block 23 Lot 51.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of an addition and replacement of the deck.  The existing dwelling is nonconforming in that it is located 17.3 feet from the road, where a 25 foot setback is required, 5.4 feet from the westerly abutter, and 0 feet from the Coastal Conservancy District.  The proposed addition will be nonconforming in that it will be located within the Coastal Conservancy District where a 50 foot setback is required and the replacement deck will be nonconforming in that it will be located 5.4 feet from the westerly abutter where a 15 foot setback is required.  The existing building coverage is 1,333 square feet (54.8%) and the proposed building coverage is 1,420 square feet (58.3%) where 15% but not more that 2,800 square feet is the maximum allowed.  The lot is nonconforming in that it contains 67 feet of frontage where 100 feet is required, contains 12,094 square feet of land area and 2,827 square feet of buildable upland where 20,000 square feet square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.

Application No. 23-066: Timothy and Nicole Tomaszewski, c/o Theodore Streibert, 15 Linden Tree Lane, Chatham MA 02633, owners of property located at 48 Overlook Drive, also shown on the Town of Chatham’s Assessors’ Map 7D Block 67 Lot M36.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling and proposed dwelling comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The existing building coverage is 876 square feet (7.4%) and the proposed building coverage is 1,122 square feet (9.5%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 11,850 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. 

Application No. 23-067: Abraham and Susanne Batthikha, c/o James M. Norcross, PO Box 707, Chatham MA 02633, owners of property located at 19 Pepper Lane, also shown on the Town of Chatham’s Assessors’ Map 15E Block 39 Lot D5A.  The Applicant seeks to enlarge, extend, or change a conforming dwelling on a nonconforming lot via the partial demolition of the existing dwelling and the construction of an addition.  The existing dwelling and proposed addition comply with all bulk and dimensional requirements of the Bylaw but is considered a substantial alteration and under the Second Except Clause of Section 6 of M.G.L. Chapter 40A, such substantial alteration requires the grant of a Special Permit.  The existing building coverage is 1,319 square feet (7.4%) and the proposed building coverage is 1,756 square feet (9.9%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 19,300 square feet of land area and 17,722 square feet of buildable upland where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. 

Application No. 23-068: Ara and Phillipa Vaporciyan, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 38 Bridge Street, also shown on the Town of Chatham’s Assessors’ Map 14A Block 4 Lot 6.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of a dormer, roof deck and stairs and an elevated platform for exterior mechanical system appliance.  The existing dwelling is nonconforming in it is located 6.7 feet from the road, 0.2 feet from the westerly abutter and is entirely within the Coastal Conservancy District (Floodplain ele. 11), where a 50 foot setback is required.  The proposed stairs will be nonconforming located 1.4 feet from the westerly abutter and the proposed mechanical platform will be nonconforming located 0.4 feet from the westerly abutter where a 25 foot setback is required.  The building coverage will remain 2,383 square feet where 2,800 square feet is the maximum allowed.  The lot is nonconforming in that it contains 0 square feet of buildable upland where 20, 000 square feet is required and contains 7,707 square feet of land area where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Sections 6 and 9 and Sections V.B. and VIII.D.2.b. of the Protective Bylaw.  

Application No. 23-069: Timothy and Ann Nolan, c/o Chris Cannon, PO Box 201, Chatham, MA 02633, owners of property located at 51 Chatham Crest Drive, also shown on the Town of Chatham’s Assessors’ Map 6D Block 1H Lot C22.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the construction of additions.  The existing dwelling is nonconforming in that it is located 14.1 feet from the westerly abutter.  The proposed addition will be nonconforming in that it will be located 13.6 feet from the westerly abutter where a 15 foot setback is required.  The existing building coverage is 1,584 square feet (10.4%) and the proposed building coverage is 1,939 square feet (12.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 15,155 square feet where 20,000 square feet square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.
