Meeting held April 13, 2023

Application No. 23-039: Town of Chatham, c/o Dr. Robert Duncanson, 261 George Ryder Road, Chatham, MA 02633, owner of property located at 610 Stage Harbor Road, also shown on the Town of Chatham’s Assessors’ Map 13A Block 34 Lot 11.  The Applicant seeks a Dimensional Variance from the required abutters setback for the construction of a public utility building.  The proposed wastewater pump station will be located 0 feet from the southerly abutter where a 15 foot setback is required.  A Dimensional Variance is required under M.G.L. Chapter 40A Section 10 and Section VIII.D.2.c of the Chatham Protective Bylaw.  

Application No. 23-031: Philip and Laurie Dumas, c/o William F. Riley, Esq, PO Box 707, Chatham, MA 02633, owner of property located at 67 Palmer Drive, also shown on the Town of Chatham’s Assessors’ Map 16G Block 37 Lot P7.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing dwelling and the construction of a new dwelling.  The existing dwelling is nonconforming in that it is located 12.6 feet from the westerly abutter and 22.2 feet from the southerly abutter.  The proposed dwelling will be nonconforming in that it will be located 8 feet from the westerly abutter and 17 feet from the southerly abutter where a 25 foot setback.  The existing building coverage is 888 square feet (8.9%) and the proposed building coverage is 1,485 square feet (14.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 10,004 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. 

Application No. 23-032: Jeffrey and Danielle Etheir, c/o Joseph Perullo, PO Box 141, North Chatham, MA 02650, owner of property located at 16 Aunt Lydia’s Way, also shown on the Town of Chatham’s Assessors’ Map 16G Block 3B Lot A3.  The Applicant seeks to construct a nonconforming accessory structure on a nonconforming lot.  The proposed accessory structure will comply with road and abutter setback requirements.  The existing building coverage is 3,000 square feet and the proposed building coverage is 3,320 square feet where 2,950 square feet is the maximum allowed.  The lot is nonconforming in that it contains 26,344 square feet where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw. 

Application No. 23-034: Ships Light Real Estate LLC, c/o Theodore Streibert, 15 Linden Tree Lane, Chatham, MA 02633, owner of property located at 79 Cross Street, also shown on the Town of Chatham’s Assessors’ Map 15D Block 109 Lot 3.  The Applicant seeks to enlarge, extend, or change a nonconforming structure on a nonconforming lot via the partial demolition of the multifamily structure and the construction of additions. The existing multifamily structure is nonconforming in that is located 20.9 feet from the road and 6.6 feet from the westerly abutter.  The proposed additions will comply with road and abutter setback requirements.  The existing building coverage is 2,091 square feet (24.2%) and the proposed building coverage is 2,085 square feet (23.8%) where 15% is the maximum allowed.  The lot is nonconforming in that it contains 8,630 square feet where 20,000 square feet is required in the R20 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Chatham Protective Bylaw.  

Application No. 23-036: William ana Barbara Richardson, c/o William G. Litchfield, Esq., 330 Orleans Road, North Chatham, MA 02650, owners of property located at 55 Strong Island Road, also shown on the Town of Chatham’s Assessors’ Map 12M Block 17 Lot B18.  The Applicant seeks to enlarge, extend, or change a nonconforming dwelling on a nonconforming lot via the demolition of the existing deck and the construction of a new deck and pergola.  The existing deck is nonconforming in that it is located 8.5 feet from the Coastal Conservancy District (flood plain ele. 12).  The proposed deck will be nonconforming in that it will be located 7 feet from the Coastal Conservancy District where a 50 foot setback is required.  The lot is nonconforming in that it contains 11,970 square feet of buildable upland where 20,000 square feet is required and contains 36,220 square feet of land area where 40,000 square feet is required in the R40 Zoning District.  A Special Permit is required under M.G.L. Chapter 40A Section 6 and Section V.B. of the Protective Bylaw.
