Ch.131 § 40, as amended and the West Tisbury Wetlands Protection Bylaw and regulations to consider a Notice of Intent filed by the Nature Conservancy on behalf of the Town of West Tisbury for property located in the northwest corner of Tisbury Great Pond known as Town Cove. The project consists of the restoration of one (1) acre of native eastern oyster habitat using shell cultch and spat-on-shell seeding with remote setting techniques. NHESP letter dated 2/28/13: no adverse effect under WPA, exempt from MESA. DMF comment letter dated 2/27/13 comments relate to required modification of Town’s shellfish propagation permit. DEP comment letter: project may require Chapter 91 Lic. and 401 Water Quality Certification (has been applied for.) Review under Section 404 Army Corp of Engineers may be required. 5:30 PM/ Map 3 Lot 85.2/SE79-336: continuation of a public hearing under the requirements of G.L. Ch.131 § 40, as amended and the West Tisbury Wetlands Protection Bylaw and regulations to consider a Notice of Intent filed by Vineyard Land Surveying & Engineering, Inc. on behalf of Maria Watson, owner of property located at 64 Blackwater Hollow Road. The project consists of the construction of a one bedroom addition to an existing structure and upgrade of the septic system in the Buffer Zone to a Bordering Vegetated Wetland. DEP comment letter: Proposed upgrade to the on-site sewage disposal system may be exempt from requirements for Riverfront Area see 310CMR 10.58 (60 (c). However an alternatives analysis pursuant to 310 CMR 10.58 (4) (c) is required.
